ANALYSIS
This bill provides that any immunization requirement established by the commissioner of health and human services shall require a two thirds vote of the legislature that such action is a necessary and appropriate response to the virus. The bill also repeals the requirement that the owner is responsible for the cost of quarantine for cargo and commodities.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Two
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Public Health Emergency Management Powers. Amend RSA 21-P:53, V to read as follows:
V. The commissioner may order a person to undergo such medical care as may be necessary to treat or prevent an incident or threat of disease or other health condition prompting an investigation pursuant to paragraph IV. Such care may include immunization of individuals as necessary to prevent the spread of contagious disease, [except that] provided that any immunization requirement shall require a two thirds vote of the legislature that such action is a necessary and appropriate response and provided further that an individual may refuse treatment or immunization pursuant to the provisions of RSA 141-C:15, VI.
2 Repeal. RSA 141-C:15, V, relative to the cost for maintenance of quarantine, is repealed.
3 Effective Date. This act shall take effect 60 days after its passage.
