AN ACT
correcting references in the statutes to house and
senate standing committee names.
Be it Enacted by the Senate and House of
Representatives in General Court convened:
9:1 House Public Works and Highway Committee. Amend RSA 9:3-a, IV and V to read as follows:
IV. There shall be a governor's advisory committee on the capital budget consisting of the following, or their designees: commissioner of administrative services, commissioner of transportation, [chairman] chairperson of the senate capital budget committee, and [chairman] chairperson of the house public works and highway committee. Members of the advisory committee may attend the hearings on capital budget requests, question those testifying, and contribute their opinions.
V. The governor shall select those projects which [he] the governor considers worthy of further evaluation, and send the requests for the selected projects to the commissioner of transportation no later than August 1. The governor may hold additional hearings on capital requests at the time of the operating budget hearings. If any additional hearing is held after election day, the governor shall invite the governor-elect to attend.
9:2 House Finance Committee. Amend RSA 9:4-a to read as follows:
9:4-a Judicial Branch Budget. The supreme court, the superior court,
and the probate judges shall prepare their own budgets and the budgets of their respective components, which they shall deliver to the chief justice of the supreme court for transmittal to the speaker of the house, the president of the senate, the house [appropriations] finance committee, and the senate finance committee, for review and processing by the legislature according to the same time schedule for budgetary review and analysis required of executive agencies. A copy of said transmittal shall be forwarded to the superior court and probate judges. The judicial branch budgets shall be prepared upon forms and according to procedures prescribed by the commissioner of administrative services. The budget request documents and such additional information as may be requested shall be submitted to the commissioner of administrative services to be included in the governor's budget in the amounts requested, and with such comments as the governor deems appropriate.
9:3 House Finance Committee. Amend RSA 9:7 to read as follows:
9:7 Hearings on Tentative Budget. Upon the receipt by [him] the governor of the tentative budget provided for by RSA 9:6, the governor shall make provision for public hearings thereon not later than the ensuing month of December, at which [he] the governor may require the attendance of the heads and other officers of all departments, and other persons receiving or requesting the grant of state funds and the giving by them of such explanations and suggestions as they may be called upon to give or as they may desire to offer in respect to items of requested appropriations in which they are interested. The governor shall also extend invitations to the governor-elect, the commissioner of administrative services, and the [chairmen] chairpersons of the [appropriation and] finance committees of the house and senate to be present at such hearings and to participate in the hearings through the asking of questions or the expression of opinion in regard to the items of the tentative budget. The [chairmen] chairpersons of the [appropriation and] finance committees of the house and senate, while sitting at such hearings, shall hold the office of budget advisors and shall receive the same per diem allowance and expenses as are provided for members of the governor's council. If either [chairman] chairperson
shall be unable to sit, the [next ranking member] vice chairperson of [his] the committee shall act in [his] the chairperson's place and receive the same compensation and expenses.
9:4 House Finance Committee. Amend RSA 12-A:2-f, II to read as follows:
II. Two members of the [appropriations] house finance committee, appointed by the speaker of the house.
9:5 House Finance Committee; Reporting. Amend RSA 12-G:26 to read as follows:
12-G:26 Audit and Annual Reports. The accounts of the authority shall be subject to an annual audit performed by an independent certified public accountant selected by the authority. The authority shall submit annually to all appointing authorities, to the house [appropriations] finance committee, [and to] the senate finance committee, the senate president, the speaker of the house, the senate clerk, the house clerk, the governor, and the state library a detailed report of its operations and a complete financial audit for the preceding fiscal year, including financial statements prepared in accordance with generally accepted accounting principles.
9:6 Presiding Officers of the House and the Senate. Amend RSA 14:26 to read as follows:
14:26 Absence from Duties. In case any one of the clerks, assistant clerks, stenographers, mileage clerks, attaches or other employees of the senate or house of representatives shall be absent from his or her duties, his or her compensation shall be suspended during [his] said absence from duty, unless the [finance committee] presiding officers of the senate or the [appropriations committee] presiding officers of the house of representatives shall otherwise determine, for good cause shown.
9:7 House Finance Committee. Amend RSA 14:27-b to read as follows:
14:27-b Expenses of the General Court During Interim. During the period when the legislature is not in session, no expenditure shall be charged against the legislative appropriation for the expenses of the legislature, exclusive of appropriations included therein for the office of the legislative budget assistant to the [appropriations] house and senate finance committees, [office of research analyst to the senate
finance committee,] and the office of the director of legislative services, without the authorization and approval of the president of the senate in the case of expenditures for the senate and the speaker of the house in the case of expenditures for the house. No expenditure of said funds shall be made without certification by the [chairman] chairperson or vice [chairman] chairperson of the senate finance committee in the case of senate expenditures or the [chairman] chairperson or vice [chairman] chairperson of the house [appropriations] finance committee in the case of house expenditures that sufficient funds are available in the particular appropriation. Authority is also granted hereby to the president of the senate and the speaker of the house to purchase supplies and equipment and to cause payment of expenses incidental to the operation and business of the legislature while the legislature is not in session. Such purchasing or payments shall be a charge upon the legislative appropriation, except such expenses as are otherwise specifically provided for by law. In the event of a vacancy in the office of president of the senate or of the speaker of the house during the period the legislature is not in session, the [chairman] chairperson of the senate finance committee or the [chairman] chairperson of the house [appropriations] finance committee respectively shall have and exercise the authority conferred upon the president and the speaker by this section.
9:8 House Finance Committee. Amend RSA 14:30-a, I to read as follows:
I. There is hereby established a fiscal committee of the general court. Said committee shall consist of 10 members. Five shall be members of the house as follows: the [chairman] chairperson of the [appropriations] finance committee and 2 other members of the committee, appointed by the [chairman] chairperson; and 2 other house members appointed by the speaker of the house. Five members shall be members of the senate as follows: the [chairman] chairperson of the finance committee and 2 other members of that committee, appointed by the [chairman] chairperson; and 2 other senators appointed by the senate president. The [chairman] chairperson of the house [appropriations] finance committee shall be the [chairman] chairperson of the fiscal committee.
9: 9 House Finance Committee. Amend RSA 14:33 to read as follows:
14:33 Dismissal. The legislative budget assistant may be dismissed at any time by vote of the fiscal committee for good cause shown in a complaint brought by the said committee. The legislative budget assistant shall be afforded due notice of any such complaint and a fair hearing before said committee before dismissal. Should the fiscal committee vote to dismiss the legislative budget assistant, [he] the legislative budget assistant may appeal [his] the dismissal to a special committee consisting of the house [appropriations] finance and senate finance committees which shall have the power to uphold or reverse the decision of the fiscal committee.
9:10 House Finance Committee. Amend RSA 17-E:2 to read as follows:
17-E:2 Membership. The committee shall consist of:
I. The president of the senate or [his] designee;
II. The speaker of the house or [his] designee;
III. The majority leaders of each house;
IV. The minority leaders of each house;
V. The [chairman] chairperson of the senate finance committee;
VI. The [chairman] chairperson of the house [appropriations] finance committee;
VII. Two members of the house appointed by the speaker of the house; and
VIII. Two members of the senate appointed by the president of the senate.
9:11 House Public Works and Highways and Finance Committees. Amend RSA 17-J:2, I to read as follows:
I. The members of the committee shall be:
(a) [Chairman] Chairperson of the house public works and highways committee;
(b) Two other members of the house public works and highways committee, appointed by the speaker of the house;
(c) Three members of the house [appropriations] finance committee, appointed by the speaker of the house;
(d) [Chairman] Chairperson of the senate capital budget committee; and
(e) Three other senators appointed by the president of the senate.
9:12 Senate Executive Departments and Administration Committee. Amend RSA 17-L:3 to read as follows:
17-L:3 Membership. The committee shall consist of 11 members, 5 of whom shall be representatives, 3 appointed by the speaker of the house, at least one of whom shall be a member of the house executive departments and administration committee, and 2 appointed by the house minority leader, at least one of whom shall be a member of the house executive departments and administration committee, and 5 of whom shall be senators, 3 appointed by the president of the senate, at least one of whom shall be a member of the senate executive departments and administration committee, and 2 appointed by the senate minority leader, at least one of whom shall be a member of the senate executive departments and administration committee. The governor, or [his] designee, shall be a non-voting member. The legislative members shall be appointed for their term of office, provided that all members shall be eligible for reappointment so long as they are qualified under the provisions of this section. Legislative members shall be appointed no later than December 30 of the year of their election to the general court, except that vacancies shall be filled for the unexpired term within 30 days of the creation of said vacancy and the initial appointments under this chapter shall be made within 30 days of August 20, 1983. The members shall choose a [chairman] chairperson from their number.
9:13 Senate Environment Committee. Amend RSA 21-I:11, II(a) to read as follows:
(a) The director, division of plant and property management, with the assistance of all state agencies, shall cooperate with the generators and managers of waste materials which may be recycled and with the producers of products which use recycled materials to maximize the state's use of those materials and products. Not later than January 15 of each odd-numbered year, the director, division of plant and property management, shall submit a report to the governor, [to] the house environment and
agriculture committee, [and to] the senate [development, recreation and] environment committee, the senate president, the speaker of the house, the senate clerk, the house clerk, and the state library on the extent to which recycled products are purchased.
9:14 House Finance Committee. Amend RSA 35-A:12, I to read as follows:
I. To assure the continued operation and solvency of the bank for the carrying out of its corporate purposes, the [chairman] chairperson of the bank shall, not later than the twentieth legislative day of each session of the general court, submit to the [chairman] chairperson of the house [appropriations] finance committee a written request for an appropriation for the sum, if any, required to insure that the bond reserve fund established under RSA 35-A:11 equals the bond reserve fund requirement therefor. The [chairman] chairperson of the house [appropriations] finance committee shall process the request for legislative action. All sums appropriated by the general court, if any, paid to the bank pursuant to this section shall be deposited by the bank in the said bond reserve fund.
9:15 House Commerce, Small Business, Consumer Affairs and Economic Development Committee. Amend RSA 125-J:11, I(a) to read as follows:
(a) Three representatives, appointed by the speaker of the house, of whom one is from the house science, technology, and energy committee; one is from the house environment and agriculture committee; and one is from the house [economic development] commerce, small business, consumer affairs and economic development committee. One of the 3 representatives shall be a member of a minority party.
9:16 House Commerce, Small Business, Consumer Affairs and Economic Development Committee; Reporting. Amend RSA 125-J:11, III to read as follows:
III. The committee shall perform an ongoing evaluation of the effectiveness of the emissions reduction credits trading program and report its findings and recommendations to the governor and council, the speaker of the house, the senate president, the senate clerk, the house clerk, the state library, the house environment and agriculture, the science, technology and energy, and the [economic development] commerce, small
business, consumer affairs and economic development committees and the senate environment and economic development committees by October 1 of each year.
9:17 Senate Environment Committee; Reporting. Amend the introductory paragraph of RSA 149-M:1-a, IV to read as follows:
IV. By December 1, 1990, and by April 1 of each even-numbered year thereafter, the department of environmental services shall submit a written report to the governor and council, senate president, speaker of the house, senate clerk, house clerk, state library, the house environment and agriculture committee, and the senate [development, recreation and] environment committee which shall include, but not be limited to, the following:
9:18 Senate Fish and Game/Recreation Committee. Amend RSA 159-C:11 to read as follows:
159-C:11 Annual Report. The department of safety shall provide the [wildlife and] fish and game/recreation committee of the senate and the public protection and veteran affairs committee of the house of representatives an annual report including the number of inquiries made pursuant to this chapter for the prior calendar year. Such report shall include, but not be limited to, the number of inquiries received from licensees, the number of inquiries resulting in a determination that the potential buyer or transferee was prohibited from receipt or possession of a handgun pursuant to state or federal law, the estimated costs of administering this chapter, the number of instances in which a person requests amendment of the record pertaining to such person pursuant to RSA 159-C:5, and the number of instances in which the superior court issued an order directing the department to amend a record pursuant to RSA 159-C:5.
9:19 House Commerce, Small Business, Consumer Affairs and Economic Development Committee; Reporting. Amend RSA 162-A:23 to read as follows:
162-A:23 Reports. The accounts of the authority shall be subject to an annual audit performed by an independent certified public accountant selected by the authority. The authority shall submit annually to the speaker of the house of representatives, the president of the senate, the senate clerk, the house clerk, the state library, the [committees] committee on commerce, small business, consumer affairs and
economic development of the house of representatives [and], the committee on economic development of the senate, and the governor and council a report on its operations and its audited financial statements for the preceding fiscal year.
9:20 House Finance Committee. Amend RSA 187-A:26-a to read as follows:
187-A:26-a Membership. The committee shall be appointed as follows: 3 senators, including the [chairman] chairperson of the senate education committee and a member of the senate finance committee, by the president of the senate; 5 representatives, including the [chairman] chairperson and at least 2 other members of the house education committee and a member of the house [appropriations] finance committee, by the speaker of the house of representatives. The chair of the study committee shall rotate biennially between the [chairman] chairperson of the house education committee and the [chairman] chairperson of the senate education committee. A member shall only serve while [he] the member is a member of the general court. The members shall not be entitled to any salary but are entitled to reimbursement for mileage and other expenses incurred in carrying out their duties. The committee may hire necessary consultants, professional or clerical personnel.
9:21 University System Study Committee; Reporting. Amend RSA 187-A:28 to read as follows:
187-A:28 Report and Recommendations. The committee shall submit a report to the general court by January 15 of each odd-numbered year, except when the university system is scheduled for sunset review pursuant to RSA 17-G. Copies of the report shall be submitted to the governor and council, [each member of the senate and the house of representatives,] the senate president, the speaker of the house, the senate clerk, the house clerk, the board of trustees of the university system, and to any other individual or organization as the committee deems advisable.
9:22 House Finance Committee; Reporting. Amend RSA 188-F:14-a to read as follows:
188-F:14-a Annual Report and Review.
I. The commissioners of the departments of education and postsecondary technical education shall issue a joint report annually on the proposed use and distribution of federal vocational funds. Such report
shall be completed by October 15 of each year. A copy of this report shall be delivered to the chairs of the house education committee, and senate education committee, the speaker of the house, president of the senate, [and] the governor, the senate clerk, the house clerk, and the state library.
II. Each year the commissioner of postsecondary technical education, as well as one representative from the board of governors, and the president of each technical institution shall appear before the house [appropriations] finance committee and the senate finance committee to review the department's programs, cost analysis, and revenue projections.
9:23 House Finance Committee. Amend RSA 188-F:38 to read as follows:
188-F:38 Membership. The committee shall be appointed as follows: 3 senators, including the [chairman] chairperson of the senate education committee and a member of the senate finance committee, by the president of the senate; and 3 representatives, including the [chairman] chairperson of the house education committee and a member of the house [appropriations] finance committee, by the speaker of the house of representatives. The chair of the study committee shall rotate biennially between the [chairman] chairperson of the house education committee and the [chairman] chairperson of the senate education committee. A member shall only serve while [he] the member is a member of the general court. 9:24 House and Senate Finance Committees. Amend RSA 193-C:7, V and VI to read as follows:
V. One member of the house [appropriations] finance committee, appointed by the speaker of the house.
VI. One member of the senate finance [executive] committee, appointed by the senate president.
9:25 House Finance Committee. Amend RSA 204-C:41, I to read as follows:
I. To assure the continued operation and solvency of the authority for the carrying out of its corporate purposes, the [chairman] chairperson of the authority shall, not later than the twentieth
legislative day of each session of the general court, submit to the [chairman] chairperson of the house [appropriations] finance committee a written request for an appropriation for the sum, if any, required to insure that the bond reserve funds established under RSA 204-C:40 equal the bond reserve fund requirement. All sums appropriated by the general court, if any, paid to the authority pursuant to this section shall be deposited by the authority in the bond reserve fund.
9:26 Gender Neutral Language. Amend RSA 211:48-b, I to read as follows:
I. No person shall use any type of net or weir for the taking of fin fish from the downstream side of the McCallen Dam to a line perpendicular with the 2 river banks from the north side of the Newmarket boat launch ramp except that the executive director of the New Hampshire fish and game department may permit netting as [he] the executive director deems necessary for propagation and scientific purposes.
9:27 House Wildlife and Marine Resources and Senate Fish and Game/Recreation Committees. Amend RSA 214:13-a to read as follows:
214:13-a Nonresident Honorary Licenses. The executive director may issue honorary hunting or fishing licenses to the President and Vice President of the United States and to nonresident governors, fish and game officials, accredited sportswriters and photographers, recognized conservationists, and foreign ambassadors and dignitaries without charge. During a calendar year there shall be no limit as to the number of each type of honorary license so issued. The executive director shall determine the form of such honorary licenses. The fish and game commission shall periodically review the total issue of honorary licenses hereunder, and may regulate the number thereof. The executive director shall on or before January 15, 1969 and biennially thereafter on or before January 15 in each year the general court assembles submit a complete list, to the [chairman] chairperson of [both] the house [and senate fish and game] wildlife and marine resources committee, and to the chairperson of the senate fish and game/recreation committee, containing the names, addresses, and positions or titles of all persons to whom such an honorary license has been issued and each such license issued shall be consecutively numbered.
9:28 House Wildlife and Marine Resources and Senate Fish and Game/Recreation Committees. Amend RSA 214:13-c to read as follows:
214:13-c Complimentary Licenses for Certain Persons. The executive director shall issue upon application complimentary resident hunting and fishing licenses to a person who is both a resident of this state and is either suffering from paraplegia or is suffering from the permanent loss of, or the permanent loss of the use of, both lower extremities. The executive director shall determine the form of such complimentary licenses. All such licenses shall be consecutively numbered. The fish and game commission shall periodically review the total issue of such complimentary licenses and, on or before January 15 each year, submit a complete list to the [chairman] chairperson of the house [fish and game] wildlife and marine resources committee and the [chairman] chairperson of the senate [development, recreation and environment] fish and game/recreation committee, containing the names and legal residences of all persons to whom such complimentary licenses have been issued. A license issued under this section shall be effective for the lifetime of the applicant unless sooner suspended or revoked by the executive director.
9:29 Gender Neutral Language. Amend RSA 215-A:3, V and VI to read as follows:
V. The chief supervisor of the bureau in the interest of safety may make suggestions concerning RSA 215-A:3-a and such rules as [he] the chief supervisor feels may be necessary for the use and control of OHRV trails, facilities and lands under bureau control or lease to the commissioner of the department of resources and economic development. The commissioner may adopt such suggestions as rules as provided in RSA 215-A:3-a. A person who fails to observe rules adopted under RSA 215-A:3-a shall be subject to the same penalties provided for in other sections of this chapter.
VI. The supervisor of the bureau shall receive all written requests from persons applying for permission to establish a highway trail crossing or trail connector on any class I, class II or class III highway for any OHRV trail. The requests shall be submitted by the supervisor to the commissioner of the department of transportation or [his] the commissioner's representative for the department's approval or disapproval. If approval is granted, the commissioner of the department of transportation may post the area with appropriate signs designating the location of the trail crossing or trail connector and providing signs for both sides of the highway at an appropriate distance from the crossing or trail connector to warn the motoring public of said crossing or trail connector.
9:30 House Wildlife and Marine Resources and Senate Fish and Game/Recreation Committees. Amend RSA 215-A:3, IX and X to read as follows:
IX. The commissioner of the department of resources and economic development shall submit an annual report to the [chairman] chairperson of the [fish and game] wildlife and marine resources committee of the house of representatives and to the [chairman] chairperson of the [development, recreation and environment] fish and game/recreation committee of the senate which details the performance of the bureau during the previous year. This report shall be submitted on or before January 15 of each year.
X. The commissioner of the department of resources and economic development shall submit an annual report to the [chairman] chairperson of the [fish and game] wildlife and marine resources committee of the house of representatives and to the [chairman] chairperson of the [development, recreation and environment] fish and game/recreation committee of the senate which details the receipts and disbursements of all grant-in-aid funds received by the bureau pursuant to RSA 215-A:23, V(a)(7) and RSA 260:61 during the previous fiscal year. This report shall be submitted on or before January 15 of each year.
9:31 House Resources, Recreation and Development and Wildlife and Marine Resources Committees. Amend RSA 233-A:2, I(i) to read as follows:
(i) Two house members, one from the resources [and], recreation and development committee and one from the [fish and game] wildlife and marine resources committee, appointed by the speaker of the house.
9:32 House Public Works and Highways Committee; Reporting. Amend RSA 235:23-a, IV to read as follows:
IV. The commissioner shall prepare a report not later than December 1 of each year which details the way in which the transportation department has expended funds for highway construction, reconstruction, and resurfacing, and for bridge construction, bridge reconstruction and bridge maintenance according to the provisions of paragraph III. The report shall also clearly evaluate how well the betterment program is achieving its purpose using quantitative measures wherever practical. The report shall be submitted no later than December 1 of each year to the president of the senate, the speaker of the house, the governor, the senate clerk, the house clerk, the state library, the [chairman] chairperson of the house public works and highways committee, and the [chairman] chairperson of the senate capital budget committee.
9:33 House Finance Committee. Amend RSA 237:26 to read as follows:
237:26 Encumbered Tolls Nonlapsing. Notwithstanding the provisions of RSA 9:18 any general appropriation of funds collected pursuant to the provisions of this subdivision which have been encumbered shall not lapse until the object for which the encumbrance was made has been accomplished. No later than 2 weeks after the convening of any regular session of the legislature, the commissioner of administrative services shall submit a list of all extensions of the time of lapsing of any such appropriation pursuant to this section to the [chairman] chairperson of the [appropriations] finance committee of the house of representatives and to the [chairman] chairperson of the senate finance committee.
9:34 House Finance Committee. Amend RSA 237:42 to read as follows:
237:42 Encumbered Tolls Nonlapsing. Notwithstanding the provisions of RSA 9:18 any general appropriation of funds collected pursuant to the provisions of this subdivision which have been encumbered shall not lapse until the object for which the encumbrance was made has been accomplished.
No later than 2 weeks after the convening of any regular session of the legislature, the commissioner of administrative services shall submit a list of all extensions of the time of lapsing of any such appropriation pursuant to this section to the [chairman] chairperson of the [appropriations] finance committee of the house of representatives and to the [chairman] chairperson of the senate finance committee.
9:35 Gender Neutral Language and Technical Correction. Amend RSA 273-A:9, IV to read as follows:
IV. The division of personnel, through the manager of [employer] employee relations and [his] the manager's staff, shall provide administrative and professional support to the governor in the conduct of negotiations.
9:36 Joint Committee on Employee Relations. RSA 273-A:9, V is repealed and reenacted to read as follows:
V. There shall be a permanent joint legislative committee known as the joint committee on employee relations.
(a) The joint committee on employee relations shall include the following members:
(1) President of the senate;
(2) Speaker of the house of representatives;
(3) Majority leader of the senate;
(4) Majority leader of the house of representatives;
(5) Minority leader of the senate;
(6) Minority leader of the house of representatives;
(7) Senate finance and capital budget committee chairpersons;
(8) House of representatives finance committee chairperson;
(9) Senate ways and means committee chairperson;
(10) House of representatives finance committee vice chairperson;
(11) House of representatives labor, industrial and rehabilitative services committee chairperson;
(12) House of representatives labor, industrial and rehabilitative services committee ranking minority member;
(13) Senate insurance committee chairperson; and
(14) Senate insurance committee vice chairperson.
(b) The chair of the committee shall rotate biennially between the president of the senate or designee and the speaker of the house or designee, provided that the president of the senate shall serve as the first chairperson under the provisions of this subparagraph, beginning with the 1995-96 biennium. In the event that the presiding officer or designee serving as chairperson resigns or for any reason is unable to serve, the other presiding officer or designee shall become chairperson, provided that such substitution shall not change the rotation provided for in this subparagraph.
(c) The joint committee on employee relations shall meet with the state negotiating committee after the first Wednesday in December in the even-numbered years as necessary, to discuss the state's objectives in the bargaining process. Meeting shall be at the call of the chairperson of the joint committee on employee relations.
(d) The joint committee on employee relations shall hold hearings on all collective bargaining agreements with state employees and on all fact-finders' reports relative to the collective bargaining process with state employees and shall submit any recommendation on such agreements or reports to the members of the senate and the house of representatives.
9:37 House Finance Committee. Amend RSA 284:20-e, II to read as follows:
II. A report summarizing testing activity shall be provided by the commission to the fiscal committee on a quarterly basis. The fiscal committee may establish guidelines for the type and extent of information to be included in the report. For the biennium ending June 30, 1995, total billings to licensees and total state expenditures for the racing lab shall not exceed $420,000 for each fiscal year. For the fiscal year ending June 30, 1996, and for subsequent years, the commission shall develop a cost allocation plan which includes all steps necessary to prevent unnecessary or excessive testing while maintaining the commission's duty to conduct as many tests as it deems necessary. Upon approval of the fiscal committee, this plan shall be presented to the governor and to the senate [finance] and house [appropriations] finance committees for their consideration in developing the budget.
9:38 Senate Executive Departments and Administration Committee. Amend RSA 316-A:4, II to read as follows:
II. If the director determines that a rule proposed for adoption is not consistent with the criteria established in paragraph I of this section, [he] the director shall notify the board in writing. If the board does not take corrective action, [he] the director shall notify in writing the joint committee on administrative rules, the senate executive departments and administration committee, and the house executive departments and administration committee for further corrective oversight action.
9:39 House Judiciary and Family Law and Senate Judiciary Committees. Amend RSA 318-B:17-e to read as follows:
318-B:17-e Drug Asset Forfeiture Guidelines Required. The department of justice shall adopt and maintain drug asset forfeiture guidelines. The attorney general shall submit the guidelines and any proposed amendments to such guidelines to the house [and senate] judiciary [committees] and family law committee and to the senate judiciary committee for review and comment at least as often as annually. The attorney general shall submit any proposed amendments to the guidelines for legislative review and comment prior to their becoming effective.
9:40 Senate Executive Departments and Administration Committee. Amend RSA 329:9-d, II to read as follows:
II. 9:41 Senate Environment Committee. Amend RSA 482:93, I to read as follows:
I. There is established the dam management review committee which shall consist of 9 members, 4 of whom shall be representatives from the resources, recreation and development committee appointed by the speaker of the house, one of whom shall be designated by the speaker as chairman of the committee; 4 members of the senate from the [development, recreation and] environment committee appointed by the president of the senate; and the director, division of water resources, department of environmental services, or his designee, who shall be a nonvoting member of the committee. Members shall be appointed for their term of office, provided that all members shall be eligible for reappointment so long as they are qualified under the provisions of this section. The members shall choose from their number a secretary. Members of the committee shall not be compensated but shall be paid legislative mileage when attending committee meetings or attending to other committee business.
9:42 Senate Environment Committee. Amend the introductory paragraph of RSA 482:93, III to read as follows:
III. The committee shall have the duty to develop policies and procedures to recommend to the speaker of the house and the president of the senate, the house resources, recreation and development committee and the senate [development, recreation and] environment committee on matters relating to the acquisition, repair, use and management of dams by the state which shall include but not be limited to:
9:43 House Judiciary and Family Law Committee. Amend RSA 494:1, VII to read as follows:
VII. The chairperson of the house judiciary and family law committee or a designee from such committee appointed by the chairperson.
9:44 House Judiciary and Family Law Committee. Amend RSA 494:2 to read as follows:
494:2 Appointment and Tenure of Office. The term of each member except the members of the judicial branch administrative council, the attorney general, the president-elect of the New Hampshire Bar Association, and the chairpersons of the senate [and house] judiciary [committees] committee and the house judiciary and family law committee shall be for 3 years and until a successor is appointed and qualified. Vacancies shall be filled for the remainder of the term in the same manner and from the same group as the original appointment. Each member of the judicial branch administrative council, the attorney general, the president-elect of the New Hampshire Bar Association, and the chairpersons of the senate [and house] judiciary and house judiciary and family law committees shall be ex officio members and shall serve during their term of office.
9:45 Effective Date. This act shall take effect 60 days after its passage.
