STATE OF NEW HAMPSHIRE
In the Year of Our Lord One Thousand Nine Hundred and Ninety-Eight
AN ACT legalizing the possession and cultivation of marijuana for medicinal purposes.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Marijuana Legalized for Medicinal Purposes. Amend RSA 318-B:10, VI to read as follows:
VI. Notwithstanding any other law to the contrary, an attending physician, in good faith and in the course of [his] such physician's professional practice only, may prescribe [and administer cannabis-type drugs, or the attending physician may cause such drugs to be administered by a nurse or intern under his direction and supervision,] marijuana to a patient [who is receiving radiation or chemotherapy treatment for cancer] whom the physician has determined would benefit from the use of marijuana in the treatment of cancer, anorexia, AIDS, chronic pain, spasticity, glaucoma, arthritis, migraine, or any other illness for which marijuana provides relief. The provisions of this chapter prohibiting the possession and cultivation of marijuana shall not apply to a patient, or to a patient's primary caregiver, who possesses or cultivates marijuana for the personal medical purposes of the patient pursuant to the written prescription of a physician. In this paragraph, "primary caregiver" means the individual designated by the patient who consistently assumes responsibility for the housing, health, or safety of that patient.
2 Effective Date. This act shall take effect January 1, 1999.
