AN ACT relative to same-sex marriages contracted outside of the state of New Hampshire.

This bill provides that same-sex marriages contracted outside the state of New Hampshire and valid in the jurisdiction where contracted shall not be recognized in New Hampshire.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand
AN ACT relative to same-sex marriages contracted outside of the state of New Hampshire.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Marriages; Same-Sex Marriages Not Recognized in New Hampshire. Amend RSA 457:3 to read as follows:
457:3 Effect of Marriage. Every marriage contracted by parties within the degrees prohibited by RSA 457:1 and 457:2 is incestuous and void, and the issue of such marriage shall be deemed children born of unwed parents; provided, however, that any marriage legally contracted outside of this state by persons not domiciled in this state and valid in the jurisdiction where contracted except for marriages between persons of the same sex, shall be recognized as valid in this state for all purposes if or once the said contracting parties are or become permanent residents of this state subsequent to such marriage and the issue of any such marriage shall be legitimate.
2 Marriages; Same-Sex Marriages Not Recognized in New Hampshire. Amend RSA 457:3 to read as follows:
457:37 Exceptions. Nothing contained in this chapter shall affect the right of Jewish Rabbis residing in this state, or of the people called Friends or Quakers, to solemnize marriages in the way usually practiced among them, and all marriages so solemnized, except as provided in RSA 457:3, shall be valid. Jewish Rabbis residing out of the state may obtain a special license as provided by RSA 457:32.
3 Effective Date. This act shall take effect 60 days after its passage.
