HOUSE BILL 550-FN
AN ACT relative to destruction of information.
This bill declares that any information requested pursuant to the right-to-know law shall not be destroyed prior to such inspection. This bill provides a procedure for when inspection is denied. Under this bill, any person who knowingly violates this provision shall be guilty of a misdemeanor.

AN ACT relative to destruction of information.
Be it Enacted by the Senate and House of Representatives in General Court convened:
175:1 New Section; Destruction of Certain Information Prohibited. Amend RSA 91-A by inserting after section 8 the following new section:
91-A:9 Destruction of Certain Information Prohibited. A person is guilty of a misdemeanor who knowingly destroys any information with the purpose to prevent such information from being inspected or disclosed in response to a request under this chapter. If a request for inspection is denied on the grounds that the information is exempt under this chapter, the requested material shall be preserved for 90 days or while any lawsuit pursuant to RSA 91-A:7-8 is pending.
175:2 Effective Date. This act shall take effect January 1, 2003.
