STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT establishing a boundary commission to determine the boundary between New Hampshire and Maine.

Be it Enacted by the Senate and House of Representatives in General Court convened:

103:1 Boundary Commission Established. There is established a boundary commission to study the boundary between New Hampshire and Maine.

103:2 Membership and Compensation.

I. The members of the boundary commission shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Two members of the senate, appointed by the president of the senate.

(c) A member of the governor's office, appointed by the governor.

(d) The attorney general, or designee.

(e) The commissioner of the department of transportation, or designee.

(f) The attorney who represented the state in the boundary litigation between New Hampshire and Maine, appointed by the speaker of the house of representatives.

II. Members of the boundary commission shall serve without compensation, except that legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

103:3 Duties. The boundary commission shall:

I. Examine the boundary between New Hampshire and Maine, with a particular focus on the Piscataqua River boundary.

II. Consider recent geographical surveys of the area.

III. Solicit information and testimony from the proper authorities in the state of Maine relative to the boundary between the 2 states.

IV. Provide recommendations regarding the perambulation of the boundary, as required under RSA 1.

V. Solicit such additional information and testimony as the commission deems necessary in the performance of its duties.

103:4 Chairperson; Quorum. The members of the boundary commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Five members of the commission shall constitute a quorum.

103:5 Report. The boundary commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the senate president, the house clerk, the senate clerk, and the governor on or before November 1, 2003.

103:6 Effective Date. This act shall take effect upon its passage.
