ANALYSIS

This bill provides that same-sex civil unions contracted outside of the state of New Hampshire and valid in the jurisdiction where contracted shall not be recognized in New Hampshire, except for health care decisions.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT relative to same-sex civil unions contracted outside of the state of New Hampshire.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Marriages; Uniform Marriage Recognition Law; Same-Sex Civil Unions Not Recognized in New Hampshire Except for Health Care Decisions. Amend RSA 457 by inserting after section 44 the following new section:

457:45 Same-Sex Civil Unions. A civil union legally contracted outside of this state by persons of the same sex who are not residents of this state and valid in the jurisdiction where contracted shall not be recognized for any purpose in this state, except for making health care decisions during stays in the state of not more than 30 days. Verification of a civil union valid in the jurisdiction where contracted shall be treated as a durable power of attorney for health care, enabling the parties to make health care decisions for each other in the event that either party is unable to do so.

2 Effective Date. This act shall take effect 60 days after its passage.
