This bill prohibits the use of new lighting that glares upward on certain highway signs beginning in 2006 and requires that by 2017, all lighting on these signs be full cut off lighting.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT relative to the lighting of certain advertising devices along highways.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Regulation of Erection and Maintenance of Certain Advertising Devices; Lighting. Amend RSA 236:74, I(a)(3) to read as follows:

(3) No lighting may be permitted to be used in any way in connection with any sign unless it is so effectively shielded as to prevent beams or rays of light from being directed at any portion of the main traveled way of the interstate, federal aid primary or turnpike highways, or is of such low intensity or brilliance as not to cause glare or not to impair the vision of the driver of any motor vehicle, or does not otherwise interfere with any driver's operation of a motor vehicle. On or after January 1, 2007, no new lighting that glares upward shall be permitted. All such new lighting shall be full cut-off lighting with the lights glaring downward toward the ground. On or after January 1, 2018, all lighting shall be full cut-off lighting.

2 Effective Date. This act shall take effect 60 days after its passage.
