STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT establishing a legislative oversight committee for the school administrative unit system.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Sections; School Administrative Units; Legislative Oversight Committee. Amend RSA 194-C by inserting after section 10 the following new sections:

194-C:11 Legislative Oversight Committee. An oversight committee shall be established consisting of:

I. The chairperson of the house education committee, or a designee.

II. The chairperson of the senate education committee, or a designee.

III. One member of the house of representatives, appointed by the speaker of the house of representatives.

IV. One member of the senate, appointed by the senate president.

V. One member of the house finance committee, appointed by the speaker of the house of representatives.

VI. One member of the senate finance committee, appointed by the senate president.

194-C:12 Duties of the Legislative Oversight Committee. The oversight committee shall monitor the process of organization and withdrawal of school districts from school administrative units and shall oversee the general operation, creation, or dissolution of school administrative units. The committee shall submit an annual report to the speaker of the house of representatives, the president of the senate, and the state board of education summarizing its findings.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 727-FN-LOCAL - FISCAL NOTE

AN ACT revising the school administrative unit system.

FISCAL IMPACT:

The Department of Education has stated this bill will have an indeterminable impact on state and local expenditures and local revenue in FY 2003 and each year thereafter. There will be no fiscal impact on county expenditures or state and county revenue.

METHODOLOGY:

The Department states this bill creates a new school administrative unit system of governance along county lines, repeals statutes that provide some of the authority for local control and gives the State Board of Education the responsibility for promulgating rules for the operation of the school administrative units. The Department is unable to determine the fiscal impact for the following reasons:

· This bill repeals law that grants local SAU school boards the authority to set salaries for personnel and gives the State Board of Education the authority to promulgate rules relative to personnel necessary for the SAU's

· Unable to estimate the salary cost of the new school administrative units because the number of employees and their salaries are unknown.

· Unable to determine the impact on school building aid since school administrative buildings are eligible for the program. Consolidated school administrative units will require larger buildings so an increase in building aid requests is expected.

· Reducing the number of school administrative units from 80+ to 10 may reduce local expenditures by an indeterminable amount.

· The residency of a student may become less important in determining which school the student attended if there was one superintendent for the entire county.

· The provisions of manifest educational hardship and best interest of the child could become less crucial with only 10 school administrative units.
