STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT requiring the commissioner of the department of education to establish a public school choice initiative.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Department of Education; Duties of Commissioner. Amend RSA 21-N:4 by inserting after paragraph X the following new paragraph:
XI.(a) Contract with 2 or more public school districts for the purpose of promoting and evaluating public school choice by pupils of the participating districts. The contract shall provide for the advice and support of pupils, parents, and legal guardians in addition to school officials in the participating districts on matters deemed appropriate by the commissioner.
(b) Any contract for public school choice formed under this paragraph shall include a guarantee that no participating school district shall receive an adequate education grant amount that is less than the amount such district was receiving on the date the district entered the contract.
2 Education Trust Fund; Uses of Funds. Amend RSA 198:39, I to read as follows:
I. The state treasurer shall establish an education trust fund in the treasury. Moneys in such fund shall not be used for any purpose other than to distribute adequate education grants to municipalities' school districts pursuant to RSA 198:42, [and] to provide education property tax hardship relief under RSA 198:55, and to provide funding for public school choice initiatives under RSA 21-N:4, XI. The state treasurer shall deposit into this fund immediately upon receipt:
3 Report by Department of Education. No later than November 1 following completion of the fiscal year covered by the contract, the commissioner of the department of education shall submit a report on the status and progress of the public school choice initiative set forth in RSA 21-N:4, XI to the chairpersons of the house and senate education committees.
4 Effective Date. This act shall take effect 60 days after its passage.

HB 785 FISCAL NOTE
AN ACT requiring the commissioner of the department of education to establish a public school choice initiative.
FISCAL IMPACT:
The Department of Education indicates this bill will increase state education trust fund expenditures and local revenue by $1,251,680 in FY 2004, $1,251,680 in FY 2005, $1,451,840 in FY 2006 and $1,451,840 in FY 2007. There will be no fiscal impact on state and county revenue or county and local expenditures.
METHODOLOGY:
The Department made the following assumptions when estimating the fiscal impact of this bill:
· 5% of school districts will participate in the choice program.
· 5% of students will take advantage of choice programs. This percentage is derived from nationwide participation figures. 5% will result in 320 students statewide.
· Of the 320 students, 50% are assumed to elementary and 50% high school.
· Enrollment will remain stable.
· The cost of the program will equal the per pupil cost of an adequate education with the cost of high school students at 1.2 times elementary.
