STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT relative to the developmental services priority waiting list and making an appropriation therefor.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Appropriation; Funding Developmental Services Priority Waiting List. There is hereby appropriated to the department of health and human services for the purposes of providing services for individuals with developmental disabilities who are identified as priority level one, as defined in section 2, the sum of $3,600,000, of which $1,800,000 shall be from general funds and $1,800,000 shall be from federal funds, for the fiscal year ending June 30, 2004; and the sum of $8,000,000 of which $4,000,000 shall be from general funds and $4,000,000 shall be from federal funds, for the fiscal year ending June 30, 2005. Such funds shall be in addition to any other funds appropriated to the department of health and human services. The governor is authorized to draw a warrant for said sums out of any money in the treasury not otherwise appropriated.

2 Priority Level One Defined. In this act, "priority level one" means an individual with a developmental disability whose needs place him or her at imminent risk of substantial physical or emotional harm or significant regression.

3 Effective Date. This act shall take effect July 1, 2003.

SB 216 FISCAL NOTE

AN ACT relative to the development services priority waiting list and making an appropriation therefor.

FISCAL IMPACT:

The Department of Health and Human Services indicated this bill, as amended by the Senate (Senate Amendment #2003-0906s), will increase state expenditures by $3,600,000 in FY 2004 and $8,000,000 in FY 2005 and each year thereafter. State revenues will increase by $1,800,000 in FY 2004 and $4,000,000 in FY 2005. There will be no fiscal impact on county and local revenue or expenditures.

This bill appropriates $1,800,000 in FY 2004 and $4,000,000 in FY 2005 from the general fund to the Department of Health and Human Services for the purposes of providing services for individuals with developmental disabilities who are identified as priority level one, as defined by this act.

METHODOLOGY:

The Department stated this bill funds services for individuals on the developmentally disabled waiting list for the next biennium. Approximately 360 individuals will be on the priority level one waiting list at the beginning of FY 2004 and 27 additional individuals will need services in FY 2005. The average cost of services within the developmental services delivery system is about $42,000 per person, per year. Therefore, the Department assumes that this bill will fund approximately 85 persons on the waiting list in FY 2004 and an additional 104 persons in FY 2005. The Department assumed that the Medicaid Program will reimburse the state for 50% of the cost of these services, therefor, the amount of revenue received will be one-half of the amount expended.
