STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT exempting from the state employee hiring delay certain positions within the regional community-technical college system which are directly responsible for child care.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Amend 2003, 319:178, II to read as follows:
II. Direct care positions, custodial positions, law enforcement positions, positions within the regional community-technical college system that are directly responsible for child care, and positions restored or created by this act or created on or after June 30, 2003 shall be exempt from the hiring delay imposed in paragraph I.
2 Effective Date. This act shall take effect upon its passage.

HB 1241 FISCAL NOTE
AN ACT exempting from the state employee hiring delay certain positions within the regional community-technical college system which are directly responsible for child care.
FISCAL IMPACT:
The Department of Regional Community-Technical Colleges indicates this bill, as amended by the House (Amendment #2004-0049h), may increase state restricted revenue and expenditures by an indeterminable amount in FY 2004. There will be no fiscal impact on county and local revenue or expenditures.
METHODOLOGY:
The Department states it is unable to determine the fiscal impact resulting from this bill which exempts certain positions from the hiring freeze. The hiring freeze was implemented by Chapter 319:178, Laws of 2003 and applies through the end of FY 2004. The impact on restricted revenue and expenditures will depend on the number of positions that become vacant and remain vacant under the freeze. The fiscal impact assumes the governor will not grant an exception pursuant to the provisions of Chapter 319:178, III, Laws of 2003. Also, the fiscal impact will depend on the potential effect of the vacancies on the ability of the Department to collect revenue.
