This bill allows active duty members and dependents of active duty members of the United States armed forces who are stationed in New Hampshire or living in New Hampshire with duty stations in contiguous states to attend public postsecondary institutions at the in-state resident tuition rate.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Seven
AN ACT allowing certain active duty members of the United States armed forces and their dependents to attend public postsecondary institutions at the in-state resident tuition rate.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subdivision; Postsecondary Education Benefits. Amend RSA 110-B by inserting after section 80 the following new subdivision:
Postsecondary Education Benefits
110-B:81 Active Duty Members of the Armed Forces; In-State Resident Tuition Rate. Active duty members and dependents of active duty members of the United States armed forces who are stationed in New Hampshire or living in New Hampshire with duty stations in contiguous states, who are otherwise eligible to attend public postsecondary institutions, may take courses at such institutions at the in-state resident tuition rate.
2 Effective Date. This act shall take effect 60 days after its passage.

HB 861 FISCAL NOTE
AN ACT allowing certain members of the United States armed forces and their dependents to attend public postsecondary institutions at the in-state resident tuition rate.
FISCAL IMPACT:
The Department of Regional Community-Technical Colleges and the University System of New Hampshire state this bill will decrease state restricted revenue and increase state restricted expenditures by an indeterminable amount in FY 2007 and each fiscal year thereafter. There will be no fiscal impact on county or local revenue and expenditures.
METHODOLOGY:
The University System of New Hampshire states this bill provides discounted tuition, at the in-state rate, to members of the armed forces and their dependents, if members are stationed in New Hampshire or living in New Hampshire with duty stations in contiguous states. The System states it cannot determine the number of individuals that may elect to take advantage of the tuition discount program. The System states the “gap” between the full-time annual tuition rate of a resident versus a non-resident during FY 2008 and FY 2009 will range from $7,320 at Keene State College (KSC) and Plymouth State University (PSU), to $13,300 at the University of New Hampshire (UNH). The System states that because it cannot determine the exact number of participants in the program, the System assumes there will be 20 participants per year at KSC and PSU, and another 30 at UNH, with an estimated cost of $545,400 [(20 x $7,320) + (30 x $13,300)].
The Department of Regional Community-Technical Colleges states it is unable to determine the fiscal impact of this bill in FY 2008 and each fiscal year thereafter because the number of students that will be eligible under this bill to attend courses at the in-state tuition rate is unknown. The Department states current in-state tuition is $164 per credit and current out-of-state tuition is $376 per credit for day school classes.
