STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to contractor bids.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Right of Civil Action; Penalties. Amend RSA 275-A by inserting after section 5 the following new section:

275-A:6 Right of Civil Action for Denial of Certain Bids; Penalties.

I. Any person or business entity that is denied a contract after submission of a bid in response to a request for proposals shall have a cause of action against another person or business entity that was awarded that contract if the other person or entity employs or employed persons it knew or should have known were ineligible for employment in the United States pursuant to the laws of New Hampshire or the United States.

II. In addition to any fines payable under RSA 275 or other laws of New Hampshire, a plaintiff with a cause of action under paragraph I may recover:

(a) Real economic damages.

(b) $500 for each such ineligible person employed by the defendant.

2 Effective Date. This act shall take effect January 1, 2008.
