STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to exemptions from auctioneering for Internet sales.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Definition of Auctioneer and Auctioneering; Internet Sales Excluded. Amend RSA 311-B:1, I and II to read as follows:

I. “Auctioneer” means a person who engages in this state in the business of selling for another real, personal or mixed property by auction; except that auctioneer shall not include a person who sells such property for another through the Internet.

II. “Auctioneering” means the business or act of selling for another real, personal or mixed property by auction; except that auctioneering shall not include selling such property for another through the Internet.

2 Effective Date. This act shall take effect 60 days after its passage.
