STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT requiring persons under 18 years of age to wear ski helmets.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Skier Responsibility; Helmet Required. Amend RSA 225-A:24 by inserting after paragraph V the following new paragraph:

VI. No person under 18 years of age shall ski, snowboard, or ski jump unless such person is wearing a helmet of a type approved by the commissioner of the department of resources and economic development.

2 New Section; Helmets Required. Amend RSA 225-A by inserting after section 23 the following new section:

225-A:23-a Helmets Required. No ski area operator shall permit any person under 18 years of age to ski, snowboard, or ski jump unless such person is wearing a helmet of a type approved by the commissioner of the department of resources and economic development. It shall be a defense to any claim of liability under this section that the ski operator established and maintained reasonable policies and procedures to enforce the requirements of this section.

3 Effective Date. This act shall take effect 60 days after its passage.
