ANALYSIS

This bill provides that the state of New Hampshire and its political subdivisions shall not serve as a sanctuary for illegal aliens and requires state and local law enforcement agencies to enforce immigration laws to the extent authorized by federal law.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to illegal aliens.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Chapter; State Enforcement of Federal Immigration Laws. Amend RSA by inserting after chapter 106-K the following new chapter:

CHAPTER 106-L

STATE ENFORCEMENT OF FEDERAL IMMIGRATION LAWS

106-L:1 Illegal Aliens. The state of New Hampshire and its political subdivisions shall not serve as a sanctuary for illegal aliens.

106-L:2 State Enforcement of Federal Immigration Laws. Law enforcement agencies of this state and its political subdivisions shall enforce federal immigration laws to the extent authorized by federal law.

2 Effective Date. This act shall take effect January 1, 2009.

SB 353-FN-LOCAL - FISCAL NOTE

AN ACT relative to illegal aliens.

FISCAL IMPACT:

The Department of Justice, the New Hampshire Association of Counties, and the New Hampshire Municipal Association state this bill may increase state, county, and local expenditures by an indeterminable amount in FY 2009 and each year thereafter. There will be no fiscal impact on state, county, and local revenue.

METHODOLOGY:

The Department of Justice states this bill would require law enforcement agencies of the state and its political subdivisions to enforce federal immigration laws to the extent authorized by federal law. The Department states it may have increased costs associated with providing the New Hampshire State police and other state law enforcement agencies needed legal counsel with respect to enforcement of federal laws. The Department is not able to determine the extent its counsel would be needed and cannot estimate the fiscal impact.

The New Hampshire Association of Counties states to the extent county sheriffs may be required to enforce laws they do not already enforce, the counties may have increased expenditures. The increased costs would be a result of personnel increases and related expenses for new and additional enforcement activities.

The New Hampshire Municipal Association states the requirement to enforce federal immigration laws may result in increased costs to municipalities. The Association is not able to estimate the increased costs.
