STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT requiring young women under 15 years of age to provide proof of counseling prior to obtaining an abortion.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Proof of Counseling Prior to Abortion. Amend RSA 132 by inserting after section 10-d the following new section:

132:10-e Proof of Counseling Prior to Abortion for Young Women Under 15 Years of Age Required. A pregnant female under 15 years of age shall provide written proof of counseling to the person performing an abortion. The pregnant female and the person providing counseling shall sign, date, and seal or notarize the document certifying the proof of counseling. The counseling shall be provided at least 48 hours prior to the submission of the certifying document. The counseling may be provided by one parent of the pregnant female, an adult sibling, an adult aunt or uncle, a grandparent of the pregnant female, or a certified religious counselor, including but not limited to a minister, priest, rabbi, or mullah. Counseling provided by a person associated with a licensed provider who performs abortions does not constitute the receipt of counseling.

2 Effective Date. This act shall take effect 60 days after its passage.
