STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT prohibiting smoking within 25 feet of playgrounds.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Smoking and Playgrounds. Amend RSA 155 by inserting after section 42 the following new subdivision:

Smoking and Playgrounds

155:42-a Smoking Near Playgrounds Prohibited.

I. In this subdivision “playground” means any park or recreational area specifically designed to be used by children that has play equipment installed, or any similar facility located on public or private school grounds, or on city, county, or state park grounds.

II. Smoking is prohibited within 25 feet of a playground.

III. Any person who violates paragraph II of this section shall be guilty of a violation and subject to a fine of not less than $100.

2 Effective Date. This act shall take effect January 1, 2010.
