AN ACT relative to drivers’ licenses and relative to the definition of “drivers’ school.”

ANALYSIS

This bill:

I. Excludes certain advanced driver instruction from the definition of “drivers’ school.”

II. Requires that a driver’s license display the licensee’s mailing address and not display the licensee’s social security number.

III. Provides that a new driver’s license be issued upon change of address for a fee of $3.

This bill is a request of the department of safety.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to drivers’ licenses and relative to the definition of “drivers’ school.”

Be it Enacted by the Senate and House of Representatives in General Court convened:

75:1 Drivers’ School. Amend RSA 259:26 to read as follows:

259:26 Drivers’ School. "Drivers' school’’ shall mean the business of giving instruction, for compensation, in the driving of motor vehicles and motorcycles. “Drivers’ school” shall not include a business or other person giving advanced instruction, with or without compensation, when the instruction is not intended to meet the requirements of basic driver training under RSA 263:44 through RSA 263:51 and the instruction is given only to licensed drivers.

75:2 Social Security Numbers and Addresses. Amend RSA 263:40-a, I(c) to read as follows:

(c) The application form for an initial driver’s license or a renewal of a driver’s license shall include [a box to check off if the applicant does not wish to have his or her social security number appear on the license, a box to check off if the applicant wishes to have his or her mailing address appear on the license instead of his or her home address, and] a box to check off if the applicant does not wish to have his or her computerized image, likeness, or photograph retained in the records of the department of safety. The driver’s license shall display the mailing address of the licensee and shall not display the licensee’s social security number.

75:3 New Paragraph; Driver’s License Fees; Change of Address. Amend RSA 263:42 by inserting after paragraph IV the following new paragraph:

IV-a. For a new driver’s license because of a change of address, $3.

75:4 Repeal. RSA 263:40-a, III-IV, relative to social security numbers and addresses on licenses, is repealed.

75:5 Effective Date. This act shall take effect 60 days after its passage.
