STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to roadside memorials.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Roadside Memorials. Amend RSA 236 by inserting after section 110 the following new subdivision:

Roadside Memorials

236:110-a Roadside Memorials. Roadside memorials at the site of an accident or untimely death may be erected and maintained within a right-of-way or adjacent area of any primary or secondary highway for a period not to exceed 90 days from the date of the event. Any such memorial shall be nondenominational in appearance, shall not obstruct the flow of traffic or interfere with highway maintenance, and in the event the flag of the United States is displayed, shall conform with 4 U.S.C. chapter 1. All roadside memorials not removed upon the expiration of 90 days shall be treated as litter.

2 Effective Date. This act shall take effect January 1, 2010.
