STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT permitting the issue of temporary licenses for certain sellers of animals.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Sale of Animals and Birds; Temporary Licenses. Amend RSA 437 by inserting after section 1 the following new section:

437:1-a Temporary Licenses.

I. A person not engaged in the business of selling animals as described in RSA 437:1 shall not advertise for sale, sell, or exchange for value more than one cat or dog in a year unless that person has a valid temporary license issued pursuant to this section.

II. Applications for temporary licenses shall be made in writing to the department accompanied by a fee of $25. Temporary licenses shall be valid for 60 days from the date of issue. No person shall receive more than 2 temporary licenses in a year.

III. A temporary licensee shall include the temporary license number in any type of advertising that announces the availability of a cat or dog for sale or exchange. The temporary licensee shall also provide the temporary license number to the person purchasing or otherwise receiving a dog or cat from the temporary licensee.

IV. Fees collected pursuant to this section shall be deposited in the companion animal neutering fund established in RSA 437-A:4-a.

V. Any person who violates this section shall be guilty of a violation and shall pay a fine of not less than $50 and not more than $200.

2 Application of Receipts; Companion Animal Neutering Fund. Amend RSA 6:12, I(b)(59) to read as follows:

(59) Moneys received under RSA 466:4, I(c), RSA 466:6, III, RSA 437:1-a, and RSA 437-A which shall be credited to the companion animal neutering fund, established in RSA 437-A:4-a.

3 Effective Date. This act shall take effect January 1, 2010.
