ANALYSIS

This bill establishes that marriage between one man and one woman shall be the only legal domestic union that shall be valid or recognized in this state. This bill repeals the laws authorizing civil unions and deletes references to civil unions.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT establishing that marriage between one man and one woman shall be the only legal domestic union that shall be valid or recognized in this state.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Validity and Recognition of Marriage Between One Man and One Woman. Amend RSA 457 by inserting after section 3 the following new section:

457:3-a Validity and Recognition of Marriage Between One Man and One Woman. Marriage between one man and one woman shall be the only legal domestic union that shall be valid or recognized in this state.

2 Reference Deleted; Cemeteries; Definition. Amend RSA 289:1, I to read as follows:

I. “Burial ground” means a private family or religious institution’s cemetery, mausoleum, or columbarium on private property and not available for use by the public. For purposes of this paragraph, the term “family” shall mean members of the immediate family and any individuals related by blood or marriage [or civil union] to members of the immediate family.

3 Reference Deleted; Board of Licensing for Alcohol and Other Drug Use Professionals. Amend RSA 330-C:3, VI to read as follows:

VI. No board member shall participate in clinical supervision or any other professional relationship with another board member in which one board member has a subordinate role to the other. In addition, no 2 board members shall be family members. For the purposes of this paragraph, persons are “family members” if they are related, live in the same domicile, and share a common economic interest in the expenses of daily living and shall include, but not be limited to, a spouse, child, or parents[, or parties that have entered into a civil union].

4 Reference Deleted; Consumer Guaranty Contracts; Prohibited Acts. Amend RSA 415-C:7, I(h) to read as follows:

(h) Unfairly discriminate based solely on age, place or area of residence, race, color, creed, national origin, ancestry, marital [or civil union] status, lawful occupation including military service, gender, religion, or blindness or other disability.

5 Repeal. The following are repealed:

I. RSA 100-A:2-b, relative to civil unions.

II. RSA 457-A, relative to civil unions.

6 Effective Date. This act shall take effect January 1, 2010.
