This bill adds renewable energy facilities to the definition of business and industrial facilities for purposes of the issuance of bonds by municipalities and industrial development authorities under RSA 162-G.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT making renewable energy facilities eligible for certain bonds issued by municipalities and business and industrial development authorities.

Be it Enacted by the Senate and House of Representatives in General Court convened:

56:1 Definition; Business and Industrial Facility; Bonding. Amend RSA 162-G:3, IV to read as follows:

IV. “Business and industrial facility” shall mean any land, any building or other improvement, and all real and personal properties, including but not limited to, machinery and equipment deemed necessary in connection therewith, whether or not now in existence, which shall be suitable for use for commercial, business service, manufacturing, warehousing, processing wastes, renewable energy, or other business and industrial purposes, but shall not include raw materials, work in process or stock in trade. Facilities incidental to the foregoing such as utility lines, storage accommodations, and transportation facilities shall be deemed to be part of a business and industrial facility.

56:2 Effective Date. This act shall take effect 60 days after its passage.
