STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT amending the Concord school district charter.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Concord School District Charter; Elections. Amend 1961, 355:2, as amended by 1967, 560; 1971, 262; 1977, 47; and 1983, 123:1, to read as follows:

355:2 Elections. The election officers in each ward whose duty it is to conduct regular state general elections shall conduct an election, as hereinafter provided, on the Tuesday after the first Monday in November, annually, to elect [3] members of the board of education of the Concord school district to serve terms of 3 years each. The Concord school district shall be divided into 3 districts based on Concord city electoral wards as follows: district 1 shall be comprised of city wards 1, 2, 3, and 4; district 2 shall be comprised of city wards 5, 6, and 7; and district 3 shall be comprised of city wards 8, 9, and 10. Three persons shall be elected to the board from each district. One person shall be elected from each district in each annual election. [For the purposes of this election,] The voters shall cast their ballots in their respective wards for the election of members of the board of education. Candidates for election to the board of education shall be listed on ballot page or pages, separate from the pages used in any other elections which may be held concurrently with the board election, as provided in section 4 of this chapter.

2 Referendum; Concord School District Charter; Elections. Section 1 of this act shall not take effect unless it is adopted by a majority vote of those present and voting at the regular school board election in November 2010 as hereinafter provided. The clerk of the Concord school district shall cause to be printed at the bottom of the ballot prepared for the election of members of the board of education the following question “Shall the provisions of an act entitled ‘An act amending the Concord school district charter’ passed at the 2009 session of the legislature, be adopted?” Beneath this question shall be printed the word “Yes” and the word “No” with a square immediately opposite each word, in which the voter may indicate his or her choice. If a majority of those voting on this question at said election vote in the affirmative on this question, this act shall be declared to have been adopted and section 1 of this act shall become effective January 1, 2011. The school district clerk shall within 10 days of said election certify to the secretary of state the result of the vote on the above question.

3 Applicability. If section 1 of this act takes effect, candidates for the Concord board of education at the 2011 municipal election shall run for a one-year, 2-year, or 3-year term.

4 Effective Date. This act shall take effect upon its passage.
