STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to the enrollment of bills and their presentation by the secretary of state.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Legislative Proceedings; Enrollment and Presentation of Bills. Amend RSA 14:8 and 14:9 to read as follows:

14:8 Enrollment of Laws. All bills and resolutions which have passed both branches of the legislature shall be forwarded to the office of legislative services to be there enrolled and prepared for submission to the governor. After such enrollment, the office of legislative services shall forward the bill or resolution [shall be forwarded] to the committee on enrolled bills for final approval. After said final approval the office of legislative services shall forward the bill or resolution to the clerk of the legislative body where the bill originated for signature by the presiding officer or designee. After execution by the presiding officer or designee, the clerk shall forward the bill to the clerk of the other legislative body for signature by the presiding officer or designee of the second legislative body. Thereafter, the bill or resolution shall be forwarded to the secretary of state for presentation. [He] The secretary of state shall keep such bills and resolutions as public records of the state. No designee shall sign a bill under the authority of this section unless his or her name has been filed by the speaker of the house of representatives with the house clerk or by president of the senate with the senate clerk, with a copy of such filing provided to the secretary of state prior to such signing.

14:9 Presentation for Approval. After any bill or joint resolution has been enrolled and approved, as provided by RSA 14:8, [and signed by the speaker of the house, or his designee, and by the president of the senate, or his designee,] it shall be presented, within 5 business days of receipt, by the secretary of state to the governor for [his] approval, and the secretary shall note thereon the day and hour of presentation for approval, and shall make a similar entry in the records of [his] the office of the secretary of state. [No designee shall sign a bill under the authority of this section unless his name has been filed by the speaker of the house or president of the senate with the secretary of state prior to such signing.]

2 Effective Date. This act shall take effect 60 days after its passage.
