STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT establishing an oversight committee to monitor liquor enforcement.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Oversight Committee to Monitor Liquor Enforcement. Amend RSA 179 by inserting after section 62 the following new section:

179:63 Oversight Committee to Monitor Liquor Enforcement.

I. There is established an oversight committee to monitor liquor enforcement. The commission shall consist of 3 members of the house of representatives, appointed by the speaker of the house of representatives, and 2 senators, appointed by the president of the senate. Terms of the members shall be coterminous with their terms in office and vacancies shall be filled by the appointing authority. Members shall be appointed within 30 days of biennial organization day. The first-named house member shall call the first meeting of the biennium; at such meeting, the members shall elect a chairman. Two members of the committee shall constitute a quorum. The committee shall meet at the call of the chairman. Members shall receive mileage at the legislative rate when attending to the duties of the commission.

II. The liquor commission shall inform the oversight committee of all enforcement actions taken by the commission. The commission shall provide sufficient information to allow the committee to perform its duties and shall provide additional information and assistance to the committee upon request.

III. The oversight committee shall contact all subjects of enforcement actions by the liquor commission and solicit their input regarding the appropriateness and fairness of enforcement actions, inspections, and other activities of the liquor commission. Information provided by licensees to the oversight committee shall be confidential and not subject to RSA 91-A. The oversight committee shall review all responses received and is authorized to hold hearings and to subpoena witnesses and documents to evaluate the appropriateness of the liquor commission’s enforcement activities.

IV. When the oversight committee deems that it is appropriate to do so, it may report its findings on any matter to the general court or recommend legislation based on the results of the oversight committee’s activities.

2 Effective Date. This act shall take effect 60 days after its passage.
