STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nine
AN ACT relative to restoration of driving privileges for persons previously licensed in other states.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Application by Person Under Revocation or Suspension in Another State. Amend RSA 263 by inserting after section 5-e the following new section:
263:5-f Application by Person Under Revocation or Suspension in Another State.
I. Upon proper application, the director may issue an operator’s license to a person previously licensed in another state and whose license was revoked or suspended if:
(a) The period of revocation or suspension has expired.
(b) The period of revocation or suspension has not expired and the applicant satisfies the following conditions:
(1) It is at least 5 years after the date of revocation or suspension.
(2) The director has received all relevant documentation of the revocation or suspension.
(3) The applicant appears personally for a hearing or review of the application.
(4) The director determines that licensing the applicant would not pose an unreasonable risk to public safety.
II. Following a hearing or review under subparagraph I(b), the director may issue an original license or a probationary license under RSA 265-A:35. The director is authorized, in his or her discretion, to require the installation of an alcohol ignition interlock device for a period to be determined by the director as a condition of licensure under subparagraph I(b). The director is further authorized, in his or her discretion, to require that the applicant furnish proof of successful completion of an impaired driver intervention program prior to the issuance of a license under subparagraph I(b).
2 Effective Date. This act shall take effect 60 days after its passage.

HB 477-FN - FISCAL NOTE
AN ACT relative to restoration of driving privileges for persons previously licensed in other states.
FISCAL IMPACT:
The Department of Safety states this bill will increase state highway fund revenue, state highway fund expenditures, and local revenue by an indeterminable amount in FY 2010 and each year thereafter. This bill will have no fiscal impact on county revenues and county or local expenditures.
METHODOLOGY:
This bill authorizes the director of the Division of Motor Vehicles to issue a driver’s license to a person whose out-of-state revocation or suspension has not expired, if the applicant satisfies certain conditions. The Department of Safety states this bill will increase highway fund revenue by $50 for every license issued under the proposed legislation. The Department also states per RSA 235:23, highway fund expenditures and local revenue would increase by $6 for each license issued under the proposed legislation (12% of $50). However, the overall increase in highway fund revenues and expenditures and local revenue remains indeterminable due to the Department’s inability to predict the additional number of driver’s licenses that would be issued as a result of the proposed legislation.
Under the proposed legislation, if the applicant’s revocation or suspension has not expired, the director of the Division of Motor Vehicles is required to have received all documentation relevant to the to the applicant’s revocation or suspension; conduct a hearing; and determine that licensing the applicant would not pose an unreasonable risk to public safety prior to issuing the applicant a driver’s license. The Department states the effective administration of the research and accountability portion of the proposed legislation would require the addition of at least two Clerk IVs. Assuming a passage date of July 1, 2009, the Department states the addition of two Clerk IVs would increase highway fund expenditures by $99,377 in FY 2010, $100,206 in FY 2011, $105,627 in FY 2012 and $111,162 in FY 2013.
