This bill authorizes the director of the division of motor vehicles to issue a driver’s license to a person whose out-of-state revocation or suspension has not expired, if the applicant satisfies certain conditions.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to restoration of driving privileges for persons previously licensed in other states.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Application by Person Under Revocation or Suspension in Another State. Amend RSA 263 by inserting after section 5-e the following new section:

263:5-f Application by Person Under Revocation or Suspension in Another State.

I. Upon proper application, the director may issue an operator’s license to a person previously licensed in another state and whose license was revoked or suspended if:

(a) The period of revocation or suspension has expired.

(b) The period of revocation or suspension has not expired and the applicant satisfies the following conditions:

(1) It is at least 5 years after the date of revocation or suspension.

(2) The director has received all relevant documentation of the revocation or suspension.

(3) The applicant appears personally for a hearing or review of the application.

(4) The director determines that licensing the applicant would not pose an unreasonable risk to public safety.

II. Following a hearing or review under subparagraph I(b), the director may issue an original license or a probationary license under RSA 265-A:35. The director is authorized, in his or her discretion, to require the installation of an alcohol ignition interlock device for a period to be determined by the director as a condition of licensure under subparagraph I(b). The director is further authorized, in his or her discretion, to require that the applicant furnish proof of successful completion of an impaired driver intervention program prior to the issuance of a license under subparagraph I(b).

2 Effective Date. This act shall take effect 60 days after its passage.
