STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Ten
AN ACT relative to the labeling of genetically modified seeds.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Genetically Modified Seeds and Organisms; Definition. Amend RSA 433:1 by inserting after paragraph X the following new paragraph:
X-a. “Genetically modified seed or organism” means any living organism that possesses a novel combination of genetic material obtained through the use of modern biotechnology including the application of in vitro nucleic acid techniques, including recombinant deoxyribonucleic acid (DNA) and direct injection of nucleic acid into cells or organelles, or fusion of cells beyond the taxonomic family, that overcome natural physiological reproductive or recombination barriers and that are not techniques used in traditional breeding and selection.
2 New Paragraph; Label Requirements for Agricultural, Vegetable and Flower Seeds. Amend RSA 433:2 by inserting after paragraph XI the following new paragraph:
XII.(a) For packages, sacks, or other containers of seed containing a genetically modified seed or organism for sowing purposes:
(a) The identity and relevant traits or characteristics of such seed, plus any requirements for its safe handling, storage, transport, and use;
(b) The contact point for further information and the name and address of the manufacturer and distributor or supplier of such seed; and
(c) The conspicuously printed words: “Contains genetically modified seeds or organisms.”
3 Effective Date. This act shall take effect July 1, 2010.
