HOUSE BILL 1193
AN ACT relative to the definition of allowable child care expenses for purposes of determining child support and establishing a legislative oversight committee relative to implementation of the 2009 New Hampshire Support Guidelines Review and Recommendations.
COMMITTEE: Children and Family Law
This bill removes the current limitations on the cost of child care for purposes of determining child support and expands the definition of “work-related expenses” to include education and training costs. The bill also establishes a legislative oversight committee relative to the 2009 New Hampshire Support Guidelines Review and Recommendations.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Ten
AN ACT relative to the definition of allowable child care expenses for purposes of determining child support and establishing a legislative oversight committee relative to implementation of the 2009 New Hampshire Support Guidelines Review and Recommendations.
Be it Enacted by the Senate and House of Representatives in General Court convened:
26:1 Child Care Guidelines; Definition of Allowable Child Care Expenses. Amend RSA 458-C:2, I-a to read as follows:
I-a. “Allowable child care expenses” means actual work-related child care expenses for the children to whom the order applies[, up to no more than an annual total of $5,000 for one child, $9,000 for 2 children, and $12,000 for 3 or more children] and includes necessary work-related education and training costs.
26:2 Legislative Oversight Committee on Child Support Established. There is established a legislative oversight committee to study the 2009 New Hampshire Child Support Guidelines Review and Recommendations, submitted to the department of health and human services by the University of New Hampshire Cooperative Extension.
I. The members of the committee shall be as follows:
(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.
(b) One member of the senate, appointed by the president of the senate.
II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.
III. The committee shall:
(a) Monitor initial implementation of legislation related to the 2009 New Hampshire Child Support Guidelines Review and Recommendations.
(b) Establish a data alliance with the New Hampshire court system to create a simple means of collecting regular data with regards to child support awards.
(c) Investigate debt leveraging, a system that permits parents experiencing high accrual of child support payments as a result of unemployment, incarceration, or other circumstances to meet child support obligations and continue parent-child connections.
(d) Research benefits of a stakeholder advisory board or consumer panel consisting of obligors, obligees, and court and legal personnel to review and comment on implementation of changes to the guidelines, disseminate back to their constituency information concerning both state and federal mandates relative to the guidelines, and to improve the quality and effectiveness of the guidelines in serving the interests of New Hampshire children.
IV. The members of the committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Four members of the committee shall constitute a quorum.
V. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2012.
26:3 Effective Date.
I. Section 1 of this act shall take effect January 1, 2011.
II. The remainder of this act shall take effect upon its passage.
