HOUSE BILL 1236
AN ACT relative to underwriting on the basis of credit information.

This bill declares that an insurer shall not base underwriting a policy of automobile or casualty insurance solely on a credit rating, a credit history, or a credit scoring model.
This bill is a request of the insurance department.

AN ACT relative to underwriting on the basis of credit information.
Be it Enacted by the Senate and House of Representatives in General Court convened:
125:1 New Section; Automobile Insurance; Underwriting on the Basis of Credit Information. Amend RSA 417-A by inserting after section 3-b the following new section:
417-A:3-c Underwriting on the Basis of Credit Information. No insurer shall cancel, refuse to write, or refuse to renew a policy of automobile insurance solely on the basis of credit information obtained from a credit rating, a credit history, or a credit scoring model, without consideration of any other applicable and permitted underwriting factors independent of credit information.
125:2 New Section; Property and Liability Insurance. Amend RSA 417-B by inserting after section 2 the following new section:
417-B:2-a Underwriting on the Basis of Credit Information. No insurer shall cancel, refuse to write, or refuse to renew a policy under this chapter solely on the basis of credit information obtained from a credit rating, a credit history, or a credit scoring model, without consideration of any other applicable and permitted underwriting factor independent of credit information.
125:3 Effective Date. This act shall take effect January 1, 2011.
