STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to notice to legal guardians of students.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Notice to Legal Guardians; Educational Programs. Amend RSA 186:11, IX-b to read as follows:

IX-b. [HEALTH AND SEX EDUCATION] NOTICE TO LEGAL GUARDIAN. Require school districts to adopt a policy [allowing an exception to a particular unit of] that gives a minimum 5 day notice to each student’s legal guardian, of any class, assembly, field trip, or event held on school property where students are invited or required to attend, which addresses: health [or], sex education, [instruction based on religious objections] sexual orientation or gender identity, or political activism. Such policy shall include a provision for the student’s excusal from participation for religious objections upon written request of student’s legal guardian and if necessary, an alternative learning plan sufficient to enable the child to meet state requirements for health education. None of the aforementioned activities shall take place on school property if the prescribed notice is not given.

2 Effective Date. This act shall take effect upon its passage.
