STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT prohibiting the sale of certain energy drinks to minors.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Chapter; Energy Drinks. Amend RSA by inserting after chapter 339-G the following new chapter:

CHAPTER 339-H

ENERGY DRINKS

339-H:1 Definitions. In this chapter:

I. “Energy drink” means a soft drink that contains 80 or more milligrams of caffeine per 8 fluid ounces advertised as being specifically designed to provide energy and generally including a combination of methylxanthines, B vitamins, and herbal ingredients.

II. “Minor” means a person under the age of 18.

339-H:2 Prohibition. No person shall sell, furnish, or give away or offer to sell, furnish, or give away an energy drink to a minor in this state.

339-H:3 Penalty; Fine. Any person who violates this chapter shall be guilty of a civil violation and shall be subject to a fine of $50 for a first offense, $100 for a second offense, and $500 for a third or subsequent offense.

2 Effective Date. This act shall take effect January 1, 2011.
