AN ACT relative to purchases by on-premises alcoholic beverages licensees and relative to liquor licenses.

I. Authorizes on-premises alcoholic beverages licensees to purchase liquor and wine from agency stores.

II. Authorizes temporary liquor licenses.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to purchases by on-premises alcoholic beverages licensees and relative to liquor licenses.

Be it Enacted by the Senate and House of Representatives in General Court convened:

310:1 Purchase of Supplies. Amend RSA 179:32, II to read as follows:

II. An on-premises licensee, with the approval of the commission, may purchase its supplies of liquor and wine from an agency store.

III. All on-premises or off-premises licensees shall purchase their supplies of beverages from licensed wholesale distributors, manufacturers, brew pubs, or as otherwise specifically provided by law.

310:2 New Section; Temporary Licenses. Amend RSA 178 by inserting after section 2 the following new section:

178:2-a Temporary Licenses. The director of licensing may issue a temporary form of any license authorized by this chapter. Temporary licenses shall be valid for the period specified in the license, which shall not exceed 90 days. Temporary licenses may not be renewed. Persons seeking a temporary license under this section shall file an application with the director of licensing which is in such form and contains such information as the commission may establish by rule consistent with the purposes of this chapter.

310:3 New Paragraph; Liquor License Applications. Amend RSA 178:3 by inserting after paragraph IX the following new paragraph:

IX-a. The director of licensing shall review each license application and submit to the commission a written recommendation on whether the license should be granted or denied. Upon deciding to grant or deny a license, the commission shall issue written findings stating its reasons for the decision.

310:4 On-Premises Cigar, Beverage, and Liquor Licenses. Amend RSA 178:20-a, II(c) to read as follows:

(c) Does not allow [minors to enter the premises] any person under the age of 18 on the premises unless accompanied by a parent, legal guardian, or adult spouse.

310:5 Effective Date. This act shall take effect 60 days after its passage.
