STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to automatic fire warning devices and carbon monoxide detection devices in dwellings.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Definition of Automatic Fire Warning Device. Amend RSA 153:1, I to read as follows:

I. “Automatic fire warning device” means a wall or ceiling mounted assembly containing [an ionization chamber or] a photoelectric type of smoke detector, control equipment, and audible alarm in one unit which detects visible or invisible particles of combustion and which, upon detection of smoke, activates the alarm; which device is listed by a nationally recognized laboratory that maintains periodic inspections of the listed equipment where produced, and whose listing states either that the equipment meets nationally recognized standards or that the equipment has been tested and found suitable for use in a specified manner.

2 Automatic Fire Warning Devices and Carbon Monoxide Detection Devices in Dwellings. Amend RSA 153:10-a, I-III to read as follows:

I. [Each unit contained in a multi-unit dwelling] All multi-unit dwellings and rental units, as defined in RSA 153:1-a, shall be equipped with electrically powered automatic fire warning devices in accordance with the NFPA 101 Life Safety Code and the NFPA National Fire Alarm Code and carbon monoxide detection devices in accordance with the NFPA 720 Standard for the Installation of Carbon Monoxide Detection and Warning Equipment in dwelling units as adopted pursuant to RSA 153:5. [On every floor level and in each common stairway and in each common hallway of a multi-unit dwelling, there shall be an automatic fire warning device and carbon monoxide detection device.]

II. Every single family dwelling which is built or substantially rehabilitated after January 1, 2010, shall be equipped with an automatic fire warning device and a carbon monoxide detection device in accordance with the state fire code adopted pursuant to RSA 153:5.

II-a. [Every rental unit as defined in RSA 153:1, IX-a shall be equipped with at least one automatic fire warning device and one carbon monoxide detection device. An automatic fire warning device shall be located in each hallway or area which is adjacent to a sleeping area. The provisions of this paragraph shall be in addition to any requirements under paragraph II.] The owner of the rental unit shall be responsible for maintaining the automatic fire warning device and carbon monoxide detection device in a suitable condition.

II-b. All automatic fire warning devices shall be photoelectric-only-type smoke detectors.

III. The state fire marshal may adopt such rules pursuant to RSA 541-A as necessary to enforce paragraphs I, II, [and] II-a, and II-b. The state fire marshal shall either enforce the provisions of this section or appoint the appropriate municipal authority to enforce the provisions of this section.

3 Effective Date. This act shall take effect January 1, 2011.
