STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT establishing a process for recall of United States Senators from New Hampshire.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Vacancy; Recall. Amend RSA 652:12, VI(c) to read as follows:

(c) The selectmen of any town or ward in the district from which the member is elected request of the governor and council that the office be declared vacant; or

VII. Has been recalled pursuant to an affirmative vote on a question to voters under RSA 663:9.

2 New Subdivision; Questions to Voters; Recall of United States Senator. Amend RSA 663 by inserting after section 8 the following new subdivision:

Recall of United States Senator

663:9 Recall of United States Senator. The general court, by an affirmative vote of a majority of all members of both houses voting separately, may submit the question “Shall Senator ___________ be recalled from the United States Senate?” to the qualified voters of the state. The question shall appear on the ballot at the next state general election. If a majority of those voters voting on the question vote “yes,” the office that is the subject of the question shall be vacant and shall be filled in accordance with RSA 661:5. Recounts of questions presented to voters under this section shall be in accordance with recounts for questions to amend the constitution.

3 Effective Date. This act shall take effect 60 days after its passage.
