ANALYSIS

This bill establishes the medical sharps advisory council to advise the legislature on program options for the collection and disposal of home-generated sharps.

This bill is a result of the commission to develop alternatives to the disposal of medical sharps in household waste as established under 2008, 259.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT establishing the medical sharps advisory council on disposal of medical sharps.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Chapter; Medical Sharps Advisory Council. Amend RSA by inserting after chapter 126-U the following new chapter:

CHAPTER 126-V

MEDICAL SHARPS ADVISORY COUNCIL

126-V:1 Medical Sharps Advisory Council Established. A medical sharps advisory council is established to monitor program options for the collection and disposal of home-generated sharps.

126-V:2 Membership; Compensation.

I. The members of the council shall be as follows:

(a) One member of the senate, appointed by the president of the senate.

(b) Two members of the house of representatives, appointed by the speaker of the house of representatives.

(c) The commissioner of the department of environmental services, or designee.

(d) The commissioner of the department of health and human services, or designee.

(e) A representative of the Waste Management Industry, appointed by the governor.

(f) A representative of sharps manufacturers, appointed by the governor.

(g) A representative of the Coalition of New Hampshire Chain Pharmacies, appointed by such organization.

(h) A representative of the New Hampshire Independent Pharmacy Association, appointed by such association.

(i) A representative of the New Hampshire Municipal Association, appointed by such association.

(j) A representative of the New Hampshire Association of Diabetes Educators, appointed by such association.

(k) A representative of the New Hampshire Medical Society, appointed by such society.

(l) A representative of the sharps disposal industry, appointed by the governor.

(m) A representative of the Coalition for Safe Community Needle Disposal, appointed by such organization.

(n) A representative of the New Hampshire Hospital Association, appointed by the association.

(o) A representative of Lakes Region Household Hazardous Product Facility, town of Wolfeboro, appointed by such organization.

(p) The president of the New Hampshire pharmacy board, or designee.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

III. The term of office for each member appointed under subparagraphs I(e) through (o) shall be 3 years, or until a successor is appointed and qualified in the case of a vacancy. The term of office for all other members shall be coterminous with the term of office for the position that qualifies that member to serve on the advisory council. A vacancy shall be filled in the same manner, but only for the unexpired term.

126-V:3 Duties. The medical sharps advisory council shall assess program options for the collection and disposal of home-generated sharps. The council shall assess progress in other states and encourage collaboration with stakeholders and successful programs. The council shall advise the legislature on these issues and shall submit a periodic report with any recommendations for future legislation.

126-V:4 Chairperson; Quorum. The members of the council shall elect a chairperson from among the members. The first meeting of the council shall be called by the member of the house of representatives. Five members of the council shall constitute a quorum.

2 Effective Date. This act shall take effect upon its passage.
