In the Year of Our Lord Two Thousand Twelve
AN ACT amending the definition of “sending district” as it applies to students attending regional vocational education programs.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Regional Vocational Education; Definition. Amend RSA 188-E:2, II to read as follows:
II. “Sending district” shall mean:
(a) A school district where students reside[, and for whom said district has tuition responsibility,] who attend a regional center, regional course, or alternative education program other than within the district itself; or
(b) If a student attends a chartered public school the sending district shall be the school district in which the student resides.
2 Effective Date. This act shall take effect upon its passage.

AN ACT amending the definition of “sending district” as it applies to students attending regional vocational education programs.
FISCAL IMPACT:
The Department of Education states this bill will have an indeterminable fiscal impact on state expenditures, and local revenue and expenditures in FY 2012 and each year thereafter. There will be no fiscal impact on state or county revenue, or county expenditures.
METHODOLOGY:
The Department of Education states this bill requires the resident district of a chartered public school student attending a regional vocational education center outside the student’s resident district to pay a share of the student’s tuition to the regional vocational educational center. In reference to this bill, the Department assumes the “resident district of a chartered public school student” to be the school district within which the student resides pursuant to RSA 193:12. The Department also assumes the “regional vocational education center serving the resident district’s high school or the resident district’s designated high school or a regional vocational education center, due to the program or course not being available at the resident district’s regional vocational education center” to be any regional career center serving the needs of the students of both the public high schools and chartered public high schools physically located within the respective career and technical education center’s purview. The Department also assumes any costs associated with parental decisions, regardless of this proposed bill, aside from transportation authorized by RSA 189:9, will be the responsibility of the parents involved, and any costs a school district agrees to bear will increase its liability to the extent of that agreement. The Department cannot estimate the fiscal impact of parental decisions, the overall number of students, the number of students who reside in the same district as their charter public high school, the out-of-district placements involved in potential tuition calculations, or the municipality of residence for those students involved in those calculations. The Department also cannot estimate the costs of tuition where the location of the career and technical education (CTE) center and the number of students attending that center from a chartered public school in the same town or near that CTE center are both unknown.
