STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT prohibiting public employees from being candidates for certain offices.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Qualifications by Office; Public Employees. Amend RSA 655 by inserting after section 10-a the following new section:
655:10-b Public Employees.
I. A state or local employee may not be a candidate for state senator or state representative.
II. A state or local employee retains the right to vote as he or she chooses and to express his or her opinions on political subjects and candidates.
III. Paragraph I does not apply to:
(a) The governor or member of the executive council.
(b) The mayor of a city;
(c) A duly elected head of an executive department of the state or municipality who is not classified under a state or municipal merit or civil-service system; or
(d) An individual holding elective office.
2 Effective Date. This act shall take effect 60 days after its passage.
