STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to the duty of a public employee labor organization to represent employees who elect not to join or to pay dues or fees to the employee organization.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Obligation to Bargain. Amend RSA 273-A:3 by inserting after paragraph IV the following new paragraph:

V. The employee organization certified by the board as the exclusive representative of the bargaining unit shall not be required to represent employees who elect not to join or to pay dues or fees to the employee organization. A collective bargaining agreement reached under this chapter shall apply only to public employees in the bargaining unit who are members of, or who elect to pay dues or fees to, the employee organization.

2 Effective Date. This act shall take effect 60 days after its passage.
