STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT relative to the use of superior court facilities in Nashua.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Terms of the Superior Court; Time; Place. RSA 496:1, I(f) is repealed and reenacted to read as follows:
(f) For the county of Hillsborough: At Manchester. Court facilities shall be maintained at Nashua for the trial of offenses committed in the former southern judicial district of the county of Hillsborough prior to the effective date of this subparagraph and for the hearing and trial of such other matters as the court may schedule in Nashua.
2 Applicability. Section 1 of this act shall take effect on the date set forth in a certification of effective date delivered by the supreme court to the secretary of state. The certification shall be delivered no less than 30 days before the effective date. Copies of the certification shall be distributed to the governor, the attorney general, the commissioner of administrative services, the speaker of the house of representatives, the senate president, the director of the office of legislative services, the county attorney for the county of Hillsborough, and the New Hampshire Bar Association.
3 Effective Date.
I. Section 1 of this act shall take effect as provided in section 2 of this act.
II. The remainder of this act shall take effect upon its passage.

HB 1655-FN - FISCAL NOTE
AN ACT relative to the use of superior court facilities in Nashua.
FISCAL IMPACT:
The Judicial Branch states this bill will decrease state general fund expenditures by $18,736 in FY 2014, $18,736 in FY 2015, and $312,991 in FY 2016. There is no fiscal impact on county and local expenditures, or state, county and local revenue.
METHODOLOGY:
The Judicial Branch states this bill would repeal and reenact RSA 496:1(f) to consolidate the operation of the Hillsborough County Superior Court in Manchester, while still allowing hearings and trials to be scheduled in Nashua. This bill will not affect the operation of the courthouse in Nashua as it will remain in operation as the site of the Nashua Circuit Court. The Branch estimates it will deliver a certification to the Secretary of State in time to allow for a September 1, 2012 consolidation date of the Hillsborough County Superior Court into a single site in Manchester. The Branch states any savings realized from this bill will be from personnel. The Branch assumes three department heads would be reclassified by the beginning of FY 2014. The reclassification of these positions will result in an annual savings of $18,736 ($15,915 from salaries and $2,821 from benefits) in FY 2014 and each year thereafter. In addition, the Branch plans to eliminate three other administrative positions (a clerk, jury clerk, and receptionist) by FY 2016 through attrition. This will result in an annual savings of $294,255 ($191,459 from salaries and $102,796 from benefits) in FY 2016 and each year thereafter. The Branch anticipates any mileage costs for Nashua area residents called as jurors can be absorbed by the Branch. The Branch no longer is reimbursing Manchester area residents called as jurors for travel to the Nashua Superior Court since the completion of the reconstruction of the Manchester Superior Court. The Branch assumes travel costs will be similar for Nashua area residents called as jurors to travel to the Superior Court in Manchester as it was for Manchester area residents that traveled to the Superior Court in Nashua.
