STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT requiring a request for proposals for the administration and management of the New Hampshire retirement system.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Purpose and Findings.

I. The New Hampshire Retirement System (NHRS) is a component unit of the state governed by statute and overseen by a board of trustees. The NHRS provides all record-keeping, administration, compliance, investment, and oversight services to the state of New Hampshire’s multiple employer pension plan and postemployment medical plans. The NHRS hires and monitors outside actuaries, attorneys, and auditors to assist in the management of the pension and postemployment medical plans. For the fiscal year of 2010, the NHRS had an annual budget of $8,311,000 to provide these services.

II. The legislature finds that the services currently provided by the NHRS can be provided more efficiently and less expensively by a private business. To accomplish the goal of increasing the efficiency and reducing the cost of the operation of the retirement system, the legislature hereby requires a formal request for proposal process to select a qualified organization to take responsibility for all aspects of the operation of the NHRS.

2 New Section; Administration and Management. Amend RSA 100-A by inserting after section 46 the following new section:

100-A:46-a Administration and Management.

I. The department of administrative services shall contract with a suitable professional services organization for the administration and management of the operations of the retirement system. The board of trustees and the department of administrative services shall prepare a description of the duties and procedures for the administration and management of the operations of the retirement system.

II. The department of administrative services shall publish a request for proposals (RFP) and shall review and consider the qualifications after receiving proposals. The department of administrative services shall negotiate a contract with the highest qualified firm for the administration and management of the operations of the retirement system at compensation which the department of administrative services determines is fair and reasonable to the state. Once negotiations have been completed and the department of administrative services has had the contract approved by the governor and council, all proposals submitted for a project shall become available for public review.

3 Effective Date. This act shall take effect July 1, 2012.
