This bill establishes a special number plate to benefit the New England Patriots Charitable Foundation. This bill also authorizes the New England Patriots Charitable Foundation to auction the right to use license plates with numbers 999 and under and distribute the proceeds for charitable purposes in New Hampshire.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT establishing a special number plate to benefit the New England Patriots Charitable Foundation.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subdivision; New England Patriots Number Plates. Amend RSA 261 by inserting after section 97-f the following new subdivision:
New England Patriots Number Plates
261:97-g New England Patriots Number Plates.
I. The director is hereby authorized to issue special New England Patriots number plates, in lieu of other number plates. The New England Patriots Charitable Foundation shall design these special plates in cooperation with the director. New England Patriots number plates may be used on passenger motor vehicles and recreation vehicles, and on any other vehicle if the director determines that the plate design may be appropriately incorporated into the requirements for the plate of that particular type of vehicle. Such plates shall be issued only upon application and upon payment of a $40 fee that shall be in addition to the regular motor vehicle registration fee and any other number plate fees otherwise required. The $40 fee shall be allocated as follows: $20 shall be forwarded to the treasurer for deposit in the general fund and $20 shall be forwarded to the New England Patriots Charitable Foundation in furtherance of its mission of assisting the youth and families in New Hampshire through donations that foster cultural diversity, education, family, and health. All proceeds received by the New England Patriots Charitable Foundation pursuant to this section shall be apportioned and distributed for charitable purposes in New Hampshire.
II. New England Patriots number plates shall be subject to an initial minimum prepaid order of 900 plates and no plates shall issue before the minimum order requirements are met. The initial order shall be administered by the New England Patriots Charitable Foundation and shall not be accepted by the division until the minimum order has been met and the appropriate forms submitted to the division. The initial order shall include a payment of $18,000 for the 900 plates from the New England Patriots Charitable Foundation.
III. The division shall retain all available number plates with numbers 999 and under. The New England Patriots Charitable Foundation is authorized to purchase the right to use any or all such numbers on New England Patriots number plates for $20 per number and shall transfer at auction the right to each number purchased. All auction proceeds shall be distributed by the New England Patriots Charitable Foundation for charitable purposes in New Hampshire. The auction winner shall have the right to use the purchased number as the registration number for any vehicle owned by such person for which New England Patriots number plates are available, and shall retain such right for so long as the person continues to pay all applicable registration and special number plate fees.
IV. Plates shall be renewed on an annual basis for $15 per set. Of this sum, $5 shall be forwarded to the treasurer for deposit in the general fund and $10 shall be forwarded to the New England Patriots Charitable Foundation.
V. Moneys due to the New England Patriots Charitable Foundation under this section shall be paid by check on a monthly basis. The division shall report to the New England Patriots Charitable Foundation monthly on the number of New England Patriots number plates issued and renewed.
VI. The director is hereby authorized to enter into agreements for the use of logos on New England Patriots number plates.
2 Effective Date. This act shall take effect July 1, 2012.

AN ACT establishing a special number plate to benefit the New England Patriots Charitable Foundation.
FISCAL IMPACT:
The Department of Safety states this bill may increase state restricted revenue by $18,000 in FY 2013 and $9,000 in FY 2014 and each year thereafter, and state general fund revenue by $36,000 in FY 2013 and $4,500 in FY 2014 and each year thereafter. The Department states it will increase state highway fund expenditures by $95,969 in FY 2013, and state restricted expenditures by $18,000 in FY 2013 and $9,000 in FY 2014 and each year thereafter. There will be no fiscal impact on county or local revenue or expenditures.
METHODOLOGY:
The Department of Safety states this bill provides authorization for it to issue special number plates for the benefit of the New England Patriots Charitable Foundation (NEPCF). The proposed legislation states such plates shall be issued for an initial $40 fee in addition to the regular motor vehicle registration fee and any other number plate fee required, with $20 of each fee forwarded to the NEPCF and the remaining $20 deposited in the state general fund. Renewal of these plates will require an annual fee of $15, with $10 of each fee forwarded to the NEPCF and the remaining $5 deposited in the state general fund. The Department states this bill also requires it to retain the NEPCF number plates with numbers ‘999’ and below in order for it to provide the NEPCF with the option of purchasing, for $20 per plate, the right to auction off these so-called ‘low-digit’ license plates. As the legislation does not specify, the Department assumes this $20 fee will be deposited in the general fund. The Department also states the bill mandates all auction proceeds to be distributed by the NECPF. The bill requires a 900 plate prepaid minimum to be met before the plates are issued, and the Department assumes this minimum will be the number of plates it issues in FY 2013. The Department also assumes all 900 of those plates issued will be categorized as low number plates with the right to auction purchased by the NEPCF. The Department’s estimates for the revenue and expenditures associated with this program are as follows:
