STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to upgrading the wiring of retail service stations to support generators or alternate power sources.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Service Station Wiring for Alternate Power Sources. Amend RSA 339-B by inserting after section 8 the following new section:

339-B:8-a Retail Service Station; Wiring for Alternate Power Source Required. No later than January 1, 2018, each retail service station, as defined in RSA 339-C:1, VIII, shall be wired with an appropriate transfer switch, and capable of operating all fuel pumps, dispensing equipment, life safety systems, and payment-acceptance equipment using an alternate generated power source. Installation of appropriate wiring and transfer switches shall be performed by a certified electrical contractor. Local building inspectors shall include this equipment and operations check in the normal inspection process before issuing a certificate of occupancy. Each service station shall retain a copy of the certificate of occupancy on-site or at its corporate headquarters. In addition, each service station shall keep a written statement attesting to the periodic testing and ensured operational capability of the equipment in accordance with the manufacturer's specifications. The required documents shall be made available, upon request, to the department of safety.

2 Effective Date. This act shall take effect 60 days after its passage.
