STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT requiring parental consent prior to a mental health examination in public schools.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Health and Sanitation; Mental Health Examinations. Amend RSA 200 by inserting after section 32 the following new section:

200:32-a Mental Health Examinations. No school personnel shall conduct a mental health examination of any child enrolled of a public elementary or secondary school in this state without the permission of the child’s parents or legal guardian.

2 Effective Date. This act shall take effect 60 days after its passage.
