STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to differential pay for certain state employees providing direct care to inmates and patients.

Be it Enacted by the Senate and House of Representatives in General Court convened:

199:1 Adjustment of Salaries of State Employees; N.H. State Prison and N.H. Hospital. Amend RSA 99:10 to read as follows:

99:10 N.H. State Prison and N.H. Hospital. Classified employees at the state prison and the New Hampshire hospital who are continuously exposed to inmates or forensic patients daily in the normal course of their duties shall be paid, in addition to their regular salary, hazardous duty pay in the amount of $25 per week unless otherwise collectively bargained.

199:2 Direct Care Employees. Amend RSA 99:11, I to read as follows:

I. The annual salaries of classified employees who are actively engaged in the care and treatment of patients or inmates at the New Hampshire hospital, Laconia developmental services, Glencliff home, New Hampshire veterans’ home, and the youth development center, and the security employees, pharmacists, and dieticians employed at the New Hampshire hospital, shall be increased by a $5 per week differential unless otherwise collectively bargained. This paragraph shall not apply to those employees who receive hazardous duty pay under RSA 99:10.

199:3 Salary Increases for Nurses. Amend RSA 99:12 to read as follows:

99:12 Salary Increases for Nurses. To the annual salary of registered or licensed practical nurses at the New Hampshire hospital, Laconia developmental services, the New Hampshire youth development center, the Glencliff home, and the New Hampshire veterans’ home shall be added a $15 per week differential increase unless otherwise collectively bargained. The provisions of this section shall not apply to those employees who receive hazardous duty pay pursuant to RSA 99:10.

199:4 Overtime for Nurses at Certain Institutions. Amend RSA 99:13 to read as follows:

99:13 Overtime for Nurses at Certain Institutions. Registered nurses and licensed practical nurses at the New Hampshire hospital, Laconia developmental services, the New Hampshire youth development center, the Glencliff home, and the New Hampshire veterans’ home, who worked more than 40 hours in any one work week shall be paid overtime on the basis of time and one-half calculated on their total salary provided for by RSA 99 unless otherwise collectively bargained. Said payments shall be made only within the limits of funds appropriated for personal services to any of said institutions and may not be charged against the salary adjustment fund.

199:5 Effective Date. This act shall take effect 60 days after its passage.
