STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT establishing a scholarship program for certain New Hampshire residents interested in attending a postsecondary educational institution in the university system of New Hampshire.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; University System of New Hampshire; Board of Trustees. Amend RSA 187-A:16 by inserting after paragraph XXII the following new paragraph:

XXIII. Administer, at no cost to the state, all aspects of the New Hampshire scholars program established in RSA 200-N.

2 New Chapter; New Hampshire Scholars Program. Amend RSA by inserting after chapter 200-M the following new chapter:

CHAPTER 200-N

NEW HAMPSHIRE SCHOLARS PROGRAM

200-N:1 Program Established. There is hereby established the New Hampshire scholars program which shall be administered by the university system of New Hampshire board of trustees. The purpose of this program is to provide partial scholarships to any person who has been a resident of New Hampshire for at least the last 5 years and is interested in pursuing either a 2-year or 4-year degree at a postsecondary educational institution with the university system of New Hampshire. All funds received pursuant to this chapter shall be nonlapsing and continually appropriated to the university system of New Hampshire for the purposes of this program.

200-N:2 Program Criteria.

I. Any student attending a public high school in New Hampshire who has been a resident of New Hampshire for at least the last 5 years and who has maintained an overall high school grade point average of at least 3.0 on a 4.0 scale shall be eligible to apply for this program. An eligible student shall submit an application to the university system of New Hampshire board of trustees, on a form developed by the board of trustees.

II. Applicants who are selected under this program shall receive a scholarship in the amount of $5,000 per academic year applicable towards tuition and fees at a postsecondary educational institution within the university system of New Hampshire. Applicants who are selected and who are pursuing a degree in a science, technology, engineering, and mathematics (STEM) discipline, as defined by the institution, shall receive a scholarship in the amount of $6,000 per academic year. The scholarship shall be for a maximum of 4 academic years.

200-N:3 New Hampshire Scholars Fund Established. There is hereby established in the office of the state treasurer a fund to be known as the New Hampshire scholars fund. The fund shall include moneys deposited pursuant to RSA 78:32 and any other sums appropriated for such purpose. In addition, the university system of New Hampshire board of trustees may accept public sector and private sector grants, gifts, or donations of any kind for the purpose of funding the provisions of this chapter. The moneys in this fund shall be nonlapsing and shall be continually appropriated to the university of New Hampshire system board of trustees for the purposes of this chapter. The fund may be expended by the university system of New Hampshire board of trustees to award partial scholarships to selected students in accordance with this chapter. The state treasurer may invest moneys in the fund as provided by law, with interest received on such investment credited to the fund.

200-N:4 Rulemaking. The university system board of trustees shall adopt rules, pursuant to RSA 541-A, relative to the following:

I. Instituting a scholarship application process, which includes but is not limited to requiring that all applicants complete a formal scholarship application on appropriate forms to be developed by the board of trustees and time frames for the application process.

II. Procedures for awarding and disbursing scholarships.

III. Procedures for determining the amount of funds available to provide annual scholarships.

3 New Subparagraph; Application of Receipts; New Hampshire Scholars Fund. Amend RSA 6:12, I(b) by inserting after subparagraph (310) the following new subparagraph:

(311) Moneys deposited in the New Hampshire scholars fund established in RSA 200-N:3.

4 Tobacco Tax; Distribution of Funds. Amend RSA 78:32 to read as follows:

78:32 Distribution of Funds.

I. The commissioner shall determine the additional amount of revenue produced by any additional tax in excess of $1.00 for each package containing 20 cigarettes or at a rate proportional to such rate for packages containing more or less than 20 cigarettes, on all tobacco products sold at retail in this state imposed by RSA 78:7 and shall certify such amount to the state treasurer by October 1 of each year for deposit in the [education trust fund established by RSA 198:39] New Hampshire scholars fund established in RSA 200-N:3.

II. The commissioner shall make quarterly estimates of the amount of additional revenues that will be produced by such increase in tax rate for the next fiscal year and shall certify such amount to the state treasurer for deposit in the [education trust fund established by RSA 198:39] New Hampshire scholars fund established in RSA 200-N:3. Such estimates shall be certified on June 1, September 1, December 1, and March 1 of each year.

5 Application of Receipts. Amend RSA 6:12, I(b)(65) to read as follows:

(65) Money received under RSA 77-A, RSA 77-E, [RSA 78,] RSA 78-A, RSA 78-B, RSA 83-F, and from the sweepstakes fund, which shall be credited to the education trust fund under RSA 198:39.

6 Repeal. RSA 198:39, I(d), relative to tobacco tax revenues deposited into the education trust fund, is repealed.

7 Effective Date. This act shall take effect 60 days after its passage.
