AN ACT relative to approval of the project proposed by the Town of Alstead for the lower Warren Brook Restoration project, establishing a commission to determine the appropriate use of flood damaged property, and repealing a commission established in 2006 to determine the appropriate use of property damaged in the October 2005 floods.

This bill approves the project proposed by the Town of Alstead for the lower Warren Brook Restoration project and reestablishes the commission established to determine the appropriate use of flood damaged property.

This bill also repeals a commission established to determine the appropriate use of property damaged in the October 2005 floods.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to approval of the project proposed by the Town of Alstead for the lower Warren Brook Restoration project, establishing a commission to determine the appropriate use of flood damaged property, and repealing a commission established in 2006 to determine the appropriate use of property damaged in the October 2005 floods.

Be it Enacted by the Senate and House of Representatives in General Court convened:

7:1 Stream Restoration Plans For Warren Brook. The general court approves the project proposed by the town of Alstead, entitled “Stream Restoration Plans for Warren Brook between Griffin Hill Road and Route 123” as recommended by the commission established in 2006, 256.

7:2 New Section; Commission to Determine Appropriate Use for Flood-Damaged Property. Amend RSA 205 by inserting after section 4-c the following new section:

205:4-d Commission to Determine Appropriate Public Use for Flood-Damaged Property. A commission is established to determine the appropriate public use of flood-damaged property purchased by the state.

I. The members of the commission shall be as follows:

(a) One member of the house of representatives, appointed by the speaker of the house of representatives.

(b) One member of the senate, appointed by the president of the senate.

(c) One member of the board of selectmen from Alstead, appointed by that town’s board.

(d) One member appointed by the governor.

(e) The commissioner of the department of transportation, or designee.

II. Members of the commission shall serve without compensation, except that legislative members shall receive mileage at the legislative rate when attending to the duties of the commission.

III. The commission shall determine the appropriate public use of flood-damaged property purchased by the state with general funds, including the possibility of creating a state park or memorial park, or using the property for other recreational or conservation purposes.

IV. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the senate member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Four members of the commission shall constitute a quorum.

V. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2013.

7:3 Repeal. RSA 205:4-d, relative to the commission established to determine the appropriate public use of flood-damaged property purchased by the state, is repealed.

7:4 Repeal. 2006, 256:4, as amended by 2007, 7:2, 2008, 87:4, and 2008, 87:5, relative to the commission established to determine the appropriate use of property damaged in the October 2005 floods, is repealed.

7:5 Effective Date.

I. Section 3 of this act shall take effect November 1, 2013.

II. The remainder of this act shall take effect upon its passage.
