STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT exempting meat and meat products from New Hampshire livestock from the FDA Food Safety and Modernization Act.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Findings. The general court finds that foods produced and sold within the state of New Hampshire are not part of interstate commerce, and therefore, are not lawfully subject to the power delegated to the Congress of the United States of America under Article 1, Section 8 “To regulate commerce with foreign Nations, and among the several States, and with the Indian Tribes.”

2 New Subdivision; Regulation of Meat and Meat Products from Livestock Located in New Hampshire Produced and Consumed in New Hampshire. Amend RSA 427 by inserting after section 59 the following new subdivision:

427:60 Prohibitions. Notwithstanding any other law to the contrary, meat and meat products produced commercially or privately in New Hampshire from livestock located in New Hampshire and that remain within the state of New Hampshire shall not be subject to the FDA Food Safety Modernization Act of 2010, Public Law (PL 111-353). It is declared by the legislature that those items have not traveled in interstate commerce. This section applies only meat and meat products from livestock located in New Hampshire that are wholly produced in New Hampshire.

427:61 Marketing of Meat and Meat Products. Meat and meat products from livestock located in New Hampshire which are produced, sold, and consumed in New Hampshire under this chapter shall have the words “Made in New Hampshire” clearly stamped, inscribed, or otherwise marked on the meat, meat product, or the container holding such meat or meat products.

427:62 Penalty.

I. Any public servant of the state of New Hampshire as defined in RSA 640:2 that enforces or attempts to enforce an act, order, law, statute, rule, or regulation of the government of the United States upon a container of meat and meat products from livestock located in New Hampshire that are produced commercially or privately in New Hampshire and that remain within the state of New Hampshire as provided in this subdivision shall be guilty of a class A misdemeanor.

II. Any official, agent, or employee of the government of the United States, or employee of a corporation providing services to the government of the United States that enforces or attempts to enforce an act, order, law, statute, rule, or regulation of the government of the United States upon meat and meat products from livestock located in New Hampshire that are produced commercially or privately in New Hampshire and that remain within the state of New Hampshire as provided in that subdivision shall be guilty of a class B felony.

427:63 Applicability. This subdivision shall apply to meat and meat products from livestock located in New Hampshire produced and retained in New Hampshire after January 1, 2015.

3 Effective Date. This act shall take effect January 1, 2015.
