STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT establishing a committee to study the feasibility of prorating the elderly property tax exemption in certain cases.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Statement of Purpose. The general court finds that:

I. It is in the interest of New Hampshire taxpayers to ensure that recipients of the elderly property tax exemption do not have household income that exceeds the qualifying amount adopted by a city or town.

II. It is in the interest of the state of New Hampshire, its local subdivisions, and its senior population to enable elderly individuals to maintain their independence from state and local support.

2 Study Committee Established.

I. There is established a committee to study the feasibility of prorating the elderly exemption in certain cases. The members of the study committee shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Two members of the senate, appointed by the president of the senate.

II. Members of the study committee shall receive mileage at the legislative rate when attending to the duties of the study committee.

III. The study committee shall:

(a) Study the feasibility of prorating the elderly property tax exemption if the owner shares occupancy in the residence with a person or persons who are not the person’s spouse and who are over 18 years of age, and the combined personal income of such occupants exceeds the qualifying amount for the elderly exemption adopted by a city or town.

(b) Determine the benefits derived by the state of New Hampshire, its local subdivisions, and its senior population when elderly individuals are able to maintain their independence from state and local support.

(c) Make recommendations for a solution that mutually benefits the interests in both subparagraphs (a) and (b).

IV. Pursuant to its duties and goals as described in paragraph III, the study committee shall solicit input from, and participation of, all interested parties that the study committee deems beneficial to its research.

V. The members of the study committee shall elect a chairperson from among the members. The first meeting of the study committee shall be called by the first-named house member. The first meeting of the study committee shall be held within 45 days of the effective date of this section. Three members of the study committee shall constitute a quorum.

VI. The study committee shall make a report of its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2014.

3 Effective Date. This act shall take effect upon its passage.
